Federal Recognition ISN'T ABOUT Getting A CASINO, Cultural Deprivation is REAL

My friend Emilio Reyes brought up some good points about lack of FEDERAL RECOGNITION of Native American Tribes.  Everyone thinks it's about getting a casino, but, NO as he explains

Being affiliated with the Tongva Tribe; a non-federally recognized tribe, deprives me from the following:

- The right to protect sacred sites, family graves and cultural objects. (NAGPRA)

- The protections guaranteed for my future children under the Indian Child Welfare Act (ICWA)

- The right to to make and sell Native American Arts and Crafts (IACA)

- The right and freedom to practice traditional rights and cultural practices. (AIRFA)

- The right for services from the Bureau of Indian Affairs (FITR)

All of the above is tantamount to being disenrolled and not recognized, let that sink in.

EMILIO REYES, of the NEWE TONGVA nation, which is working for their federal recognition and a contributor/media analyst to our website has scored  a coup with his challenges to the Bureau of Indian Affairs, read how Javin Moore was called out.  After a number of email exchanges including this one below, with FOIA officer Jessica Rogers, this seems to be more of their OKIE DOKE maneuvers.

In a previous court case, it was determined thru the Court that the BIA CANNOT withhold or redact 1928 CA Indian Applications related to the 1933 Indian Census Roll as they are in the public domain with no restrictions.


The Agency continues to be non-compliant to my FOIA requests, even after the previous win case. The records requested in this FOIA request pertain to a family allegedly claiming affiliation with the Hopland Band of Pomo Indians, but are listed in the early records as Cabazon Indians. Similar story is happening in other tribal bands such as the San Pasqual Band Of Mission Indians.

In 2004, 130+ adult members and their immediate families were disenrolled from the Pechanga Band. The members were all descendants of Chief Pablo Apish, a historically significant leader of the Pechanga/Temecula people. None of the members were allowed to participate in the 2004 tribal elections as a result of their disenrollment.

Duncan Hunter, who studiously AVOIDED the abuses of CASINO Indian Tribes on their people in his district, while simultaneously accepting of their donations...has been INDICTED.

California Republican Duncan Hunter and his wife Margaret have been indicted for allegedly using $250,000 in campaign funds for personal expenses, including dental work and trips to Italy and Hawaii.
To conceal their purchases, the Duncans misclassified purchases in their campaign finance records, labeling expenses as “campaign travel” or “dinner with volunteers” in submissions to the Federal Elections Commission.

Hunter, along with Rep. Chris Collins of New York, were the first members of Congress to endorse Donald Trump in 2016 in his run for the presidency. Both men have now been indicted.

Bureau of Indian Affairs HELPS PALA Executive Committee to TRAMPLE on Tribe's Governing Documents

The latest CUPA NEWSLETTER calls out Robert Smith's Exec Committee AND the BIA.

For nearly 25 years the governing documents of the Pala Band have been trampled on by the BIA in cahoots with Pala’s Executive Committee. In 1994 Pala was supposed to adopt a new Constitution.

That Constitution included Kupa as part of the blood requirement. But the BIA took it out. From 1994-1997 the BIA requested all kinds of changes to the Constitution that Pala’s Executive Committee rejected in favor of their 1997 version of the Constitution.

After Freedmen Court Victory over CHEROKEE, Muscogee Creek Battle is NEXT

A lawsuit against Muscogee (Creek) Nation Principal Chief James Floyd, the U.S. Department of the Interior and its Secretary Ryan Zinke, was filed in U.S. District Court for the District of Columbia July 20 by the Muscogee Creek Indian Freedmen Band Inc.  Part of whose mission statement is:  To Preserve and Protect the unique history, heritage and genealogy of the Muscogee Creek Indian Freedmen who were removed to Indian Territory (Oklahoma) on the Trail of Tears.  For those who need REMINDING The Indians DRAGGED their SLAVES on the Trail of Tears...

The suit, which lists five individual plaintiffs along with the MCIFB, alleges in its preliminary statement that pursuant to Article 2 of the Creek Treaty of 1866 between the U.S. and MCN that Freedmen and Freedmen descendants regardless of their ‘blood’ status “shall have and enjoy all the rights and privileges of Native citizens” of MCN.
The statement goes on to allege that MCN and its federal benefactors have, ‘perpetuated race-based discrimination and the badges of slavery by using the Freedmen Descendants’ African ancestry to deny them the rights and benefits of MCN citizenship.’
Among the court’s 13 declaratory and injunctive action headings in the plaintiffs’ suit are declarations that: Creek Freedmen descendants are Creek citizens with the right to full and equal citizenship; the 1979 MCN Constitution is void; and the designation or description ‘Creek Freedmen’ is a badge of slavery.

PECHANGA Tribe of Temecula NOW a FACIST SOCIETY Meeting 14 Early Warning Signs

Fascism  is a form of radical authoritarian ultranationalism, characterized by dictatorial power, forcible suppression of opposition and strong regimentation of society and of the economy,

Pechanga, since the advent of Disenrollment has pushed the Facist envelope, with four of five descriptors above covered.   

What got me thinking about this was a Facebook picture of the "Early Warning Signs of Facism" which was purported to be on display in the Holocaust Museum.  It wasn't, it WAS for sale in the gift shop however. Laurence Britt created this list during George W. Bush’s tenure as president of the United States. While he did not actually name Bush, he wrote in the original article that some of the early warning signs had already manifested in the United States:  Let's see how they match up:

As we are 7 months from the last   and possibly final STOP DISENROLLMENT DAY.  The  #stopdisenrollment movement helps draw attention, but what about the other 364 days of the year?


Do we fight the unJUST action, or do we JUST HOPE something will happen?

Do we pray for JUSTICE or actively SEEK JUSTICE for our ancestors?


Do we wait and see while our elders die without seeing their rights restored, knowing we didn't do ENOUGH?

MORATORIUM: 100 Tosobol Descendants Left Out In Pechanga Tribe's Moratorium

Word from Facebook that Michael Rios is feeling poorly and will be undergoing surgery this week.  We hope and pray for a successful outcome.  Sadly the patriarch of the Petra Tosobol descendants Manuel Rios, Sr, passed away before getting JUSTICE.  How many of the MUNOA relatives must die, before they do the right thing at Pechanga.

Here is a repost, of an article written years ago, but it's a REMINDER, that it's not JUST about tribal disenrollment, but many Natives are caught in membership moratoriums.  Can anyone believe that the Pechanga Enrollment committee members are too stupid to process the paperwork they've had for DECADES?


It's well known in California that the Pechanga Band of Luiseno Mission Indians has terminated over 25% of their tribal members in two massive eliminations. Coincidentally, each family was removed just prior to tribal elections. (story reprised from earlier post)



What many people still are unclear about, is Pechanga's so-called moratorium on membership. 


This was put into place under the premise that the enrollment committee had to "catch-up" on all the membership claims. Of course, that was a ruse to simply keep rightful members from joining the Band as per the Tribal Constitution. Pechanga's Chairman Mark Macarro has claimed it's "not about the money". Pechanga's per capita payments were $10,000 per month when the first family, descendents of Pablo Apis were erased from the tribe. When the Hunter Family was disenrolled, (a term created to make it sound like Indians were kicked out of the PTA or country club) the per capita was $20,000 per month. Now, the tribe is giving $30,000 per month to those remaining. Raise your hand if you think it "wasn't about the money".

The BIA Violates Sovereignty When it is In their Best Interest: Disenrollments Violate ICRA

Civil Rights attorney Donald R. Daines has written a post for us concerning the BIA and those with a "BIA Agenda", which surprisingly can be some tribal leaders.

The US BIA only violates Sovereignty when it is in their best interest. That’s why the BIA is known as the Bureau of Indian Annihilation. Once the BIA inserts the people its wants in power over the Tribal Nation, then when the People object and want their real leaders, the BIA says it cannot interfere because the dispute (which the BIA created in the first place) is an ‘internal’ problem which Tribal sovereignty prevents the BIA from interfering with. What took place in 1993 with the Oneida Indians of New York (not the Oneida Indian Nation that has existed for a 1,000 years as part of the Haudenosaune, but an entirely new ‘tribe’ called the Oneida Indian Nation of New York) is a textbook example of how the BIA (Bureau of Indian Annihilation) works.

I was thinking the other day about what really makes people mad.  Why doesn't Apartheid, Segregation, Elder Abuse or Child Abuse bad enough for people to be upset anymore? 

We just posted on our blog about Trevor Noah performing at Pechanga, which DOES practice segregation and apartheid.   I'm betting he wouldn't perform at SEA WORLD because they "mistreat" ORCAS.... but mistreating people.... NO BIG DEAL

Wannabee Cherokee FAKER Elizabeth Warren Get HUGE DOSE of KARMA Having to Speak AFTER a REAL Indian

Elizabeth Warren really got a big dose of karma when Netroots Nation organizers scheduled her appearance immediately after the first female Native American to run for a seat in the US Congress.


Fake Indian, Senator Elizabeth Warren earned the nickname when she allegedly lying about her “Native American heritage”   (Link is to POLLY"S GRANDDAUGHTER site that has the evidence) as a way to jump the line in front of other qualified candidates for a teaching position at the prestigious Harvard University. One year ago, Warren’s Republican opponent for US Senate in Massachusetts, gained quite a bit of attention when he sent her a DNA kit as a birthday gift.

 “My name is Deb Haaland, I’m the Democratic nominee for New Mexico’s 1st Congressional District. If elected, I would be the first Native American woman in Congress,” Haaland said.  OP: Guess she doesn't believe the lying WARREN EITHER..LOL

Haaland spoke right before Sen. Elizabeth Warren (D., Mass.), who has claimed Native American heritage in the past. Warren’s claims of Cherokee and Delaware Indian heritage became a subject of controversy in 2012 when it was revealed she had no documented proof. The senator said she instead relied on family lore to substantiate her ancestry claims.

Department of Interior's Decision HARMS 300 Nooksack; Federal Judge Tosses RICO SUIT

A Washington federal judge on Tuesday tossed a suit by Nooksack Indian Tribe members alleging tribal officials conspired to disenroll them, saying that the federal government’s recognition of tribal leadership deprived the court of jurisdiction over those claims.

In an order Tuesday, U.S. District Judge John C. Coughenour said that the U.S. Department of the Interior’s decision to reinstate recognition of the tribe’s leadership following a December election meant that he could no longer consider the tribe members’ claims under the Racketeer Influenced and Corrupt Organizations Act.
