CUPENO People and Pala People Were Federally Recognized TOGETHER, NOW ONLY ONE Has The Recognition

The Federal Government has allowed the de-recognition of the Cupeno people, while still recognizing Pala's right to disenrollment them.   The Feds PUT THEM TOGETHER, should they have all the information needed to RECOGNIZE the Cupeno people. 

WHY would the Department of Interior delay in giving the Cupeno people  their rights?   The same reason a dog licks its balls: Because they can.

They restored the rights to the TEJON BAND, they can easily do that with the Cupeno people.  In fact, the Pala Tribe could probably give them all the information.  In fact, President Joe Biden could make this happen:   Historically, federal recognition could arise from treaty, executive order, or course of dealing

Reorganization Act (9th District Appeals)

The Reorganization Act did not apply to any reservation where a

majority of the adult Indians voted against its application “at

a special election duly called by the Secretary of the

Interior.” Id. § 5125. Interior held a single election for the

Indians residing on both tracts of the Pala Reservation—the

Cupeño and the Luiseño. The Indians overwhelmingly

rejected the Reorganization Act. While the Indians residing

at Pala considered themselves distinct, Interior considered it

“one reservation and no distinction [was] made between the

lands acquired at different times.” Some other federal

government records from that period distinguish between the

Cupeño and the Luiseño at Pala.

The tribe's unique history had long been reflected in how it appeared on the BIA's annually-published list: as the "Pala Band of Luiseño Mission Indians of the Pala Reservation, California." With the Cupeño descendants largely out of the picture, though, there was no need to remind everyone of the distinct communities on the reservation. Starting in 2016, as the last of the anti-disenrollment lawsuits was defeated in the federal courts, the tribe became simply known as the "Pala Band of Mission Indians."

When CA tribal Casinos opened up against the wishes of Gov. Gavin Newsom. Tribes put their concerns for cash, over the health and safety concerns of CA's health experts.  

Since the casinos reopened, San Diego county public health officials say 112 employees and 196 patrons with confirmed COVID-19 diagnoses visited a local casino within 14 days of their illness. The 308 cases are as of Oct. 5 and include three people who died.

Pala Casino, Spa & Resort in northern San Diego County is among the casinos that will reopen its doors on Friday, May 22.

In postings to its social media pages, Pala announced that it will open at 10 a.m.

On its website, the casino says it is opening its gaming floor, its hotel with limited availability and some of its restaurants with modified hours.

Other locations, including its fitness center, spa, pool and buffet, will remain closed temporarily.

For nearly 25 years the governing documents of the Pala Band have been trampled on by the BIA in cahoots with Pala’s Executive Committee. In 1994 Pala was supposed to adopt a new Constitution.

That Constitution included Kupa as part of the blood requirement. But the BIA took it out. From 1994-1997 the BIA requested all kinds of changes to the Constitution that Pala’s Executive Committee rejected in favor of their 1997 version of the Constitution.

The organization at times has exerted significant political power in the state. But its membership waned in recent years and the group was down to just one tribe: the Pala Band of Luiseño Indians.

The Pala Band is no longer alone anymore. The Picayune Rancheria of Chukchansi Indians rejoined the organization after a seven-year absence.

The movement #StopDisenrollment began on February 8th.  Their Facebook Page grew from zero to 2,000 LIKES in less than four days.  AWARENESS of the crimes against tribal members, BY tribal leaders is growing.

The CHILDREN are harmed by disenrollment, as are our elders. Stripping of Citizenship is SO rare in America, that there is NOT one prominent case of that happening.

Over 100 Injured in FIVE CA Tribal Casino Tour Bus Crashes in The Last FOUR MONTHS.

It's time for Tribal Casino patrons to look a little closer at their bus transports in Southern California.

With news of the two recent crashes this week that resulted in 1 fatality and over 50 injured, that brings the total of the SIX crashes of casino tour buses in just the past 4 months to over 110 injured. If you ad the Pechanga shuttle bus crash of last year, the total rises above 120 injured.

Makes you wonder if casinos have any concern over whether the companies they charter are safe, doesn't it?

Should casinos require safety records for charters to their casinos?   Should our state be looking into this issue and crackdown on permits?    What do you think?

Indian Country Today: Loss of Citizenship via Disenrollment is a DISASTER

What is happening at Nooksack is making the national stage.  It helps those who have been victims of corrupt activities to keep bringing their stories forward.   Pechanga, Chukchansi, Redding, Pala, Cherokee Freedmen all have disenrollment stories, and they are not alone. Moratoriums have harmed hundreds, and loss of federal recognition, like the Mixed Blood Uinta Utes are stories that also need to be learned.

Read this opinion piece from Indian Country Today:

Prof. David Wilkins is dismayed by language chosen by the Chief Judge of the Nooksack Tribal Court in a disenrollment decision.

His dismay is directed not at the holding of the case, which supported the sovereign authority of the Nooksack Nation to be stupid, but to the Chief Judge’s assertion that tribal enrollment is of less legal import than loss of US citizenship.

Nowhere in Prof. Wilkins’s critique of the opinion does he touch the essential argument the judge made: “While the impact on the disenrollee is serious and detrimental, it is not akin to becoming stateless.”

I propose a thought experiment. Suppose that the persons subject to disenrollment by the Nooksacks had US citizenship not by the right of birth set out in the Fourteenth Amendment, but rather a derivative citizenship based on the Indian Citizenship Act of 1924.

Suppose that upon disenrollment, US passports had to be surrendered, Social Security numbers cancelled. Would that not be at least a different kettle of fish, if not two seasons ofThe Deadliest Catch?

Disenrollees would be insulted and diminished. They may have lost affirmative action consideration if it existed anymore. They would have lost any benefits that flow though membership in the Nooksack Social Club—for so it will render itself by its own actions.

Disenrollees are not stateless persons in two senses. The first is that they still have passports and the consular rights those passports confer. They still have Social Security cards and access to the anemic social safety net those cards confer.

The second is that they are still citizens of the Nooksack Nation to the degree it still exists, as the Cherokee Nation does, as the Six Nations do, as the Navajo Nation does…I am not fully informed how many tribal nations survive, but I’m certain that it’s a substantially smaller number than can be found in 25Code of Federal RegulationsPart 83.

You don’t get your tribal citizenship from the US government.

Either something of your tribal identity, your peoplehood, survives as more than family folklore or it does not.

 

Pala Disenrollments Discovered by LA TIMES; Is Robert Smith, Chairman of Pala Lying?

The shameful disenrollments at Pala are in the news.


But now, renewed doubts about Britten's lineage are at the root of a divisive "blood quantum" dispute roiling the 1,000-member Pala Band of Mission Indians, formed by the fusion of the Cupeño and Luiseño bands.

At issue is whether Britten was a full-blooded Indian. OP: That issue was settled by the BIA decades ago.

The governing board of the Pala Band in the last year has "disenrolled" some 162 descendants of Britten, cutting them off from their monthly share of the tribe's profit from casino, hotel and other business ventures, about $7,500 a month, in addition to health insurance and other benefits.

The Pala dispute echoes those at other Indian tribes in California and elsewhere, where money has complicated disputes over identity, nationhood and personality conflicts, according to David Wilkins, professor of American Indian studies at the University of Minnesota and a member of the Lumbee tribe in North Carolina.

"Somewhere, as tribes have tried to reconstruct their sense of nationhood, particularly in tribes with casino money, they hit upon disenrollment as a way to settle disputes over personality issues and money," Wilkins said.

The American Indian Movement estimates that upward of 3,000 tribal members from two dozen tribes in California and other states have been "disenrolled" in the last 15 years. "Tribes are being destroyed by it," Wilkins said.

Firms now offer DNA testing to prove Indian ancestry, while "disenrollment clubs" offer succor to those no longer welcome in their tribes. Angry websites collect accusations of betrayal.

Robert Smith, Pala's strong-willed chairman, is not moved by the appeals of those who have been disenrolled, nor by the dire assertions of Wilkins, nor by recommendations from Bureau of Indian Affairs officials to reverse the disenrollment decisions.

Smith said evidence shows Britten's father was a white man, not an Indian, and thus Britten and her progeny were not full-blooded Indian.

"This is not about money, this is about what's right," Smith said during an interview at the casino's food court, to the plink-plink of nearby slot machines. "I've heard all the arguments about Margarita Britten. All the old people knew: She was only half-Indian." OP: All the current people know, Robert Smith is a tyrant.

Pala Chairman Robert Smiths Meets With President Obama at Conference

The chairman of the Pala Band of Mission Indians met with President Barack Obama on Thursday as part of a 12-member delegation of tribal leaders to discuss American Indian issues ranging from law enforcement to health care. Pechanga Chairman Mark Macarro was not chosen to meet with the President.

The face-to-face meeting with the president was part of the larger White House Tribal Nations Conference, a one-day meeting held at the Department of the Interior in Washington, D.C., to give tribal leaders an opportunity to meet and talk with representatives of the Obama administration.

Pala Chairman Robert Smith said he was honored to have been chosen to represent California Indian tribes at the meeting with the president.

                                                            

"It was quite an experience," Smith said. "I was surprised and happy." 

In the 20-minute meeting, Smith said, he emphasized the need to appoint more American Indian judges in federal courts and the need for more funding for the Bureau of Indian Affairs to provide services for poor and nongambling tribes.   Violations of civil rights by Indian tribes should also be a topic of discussion
