U.S Attorney Looking to SETTLE San Pasqual Descendant Lawsuit and Provide JUSTICE

The true San Pasqual descendants have been royally screwed by the Bureau of Indian Affairs and the United States.  We've reported about the lawsuit filed against BIA,  and now there's an ....inkling of positive news.

From a San Pasqual faction FB Page (REZTALK) here's what attorney Alexandra McIntosh, who has been working extremely hard to support the rights of San Pasqual people harmed by those with NO blood of the band:



I received a phone call from the United States Attorney in San Diego regarding the lawsuit we filed on behalf of the true San Pasqual descendants against the United States government, Department of the Interior and Bureau of Indian Affairs. 

While we do not have the specific details of a stipulation, agreement or final settlement worked out, the United States would like to move toward a settlement and a dismissal of the suit. Emilio Reyes spent a considerable amount of time working on research at the archives to cement the evidence of betrayal, and failure in the trust responsibility of the government.  He's the FOIA king.



Which means taking steps toward enrollment of the plaintiff true San Pasqual descendants. These details are ONLY preliminary at this time. Until there is a signed agreement between this office and the US government, the negotiations are not done.

In the mean time, should we be moving positively toward a resolution, then I will grant the US government a continuance as we work out the details. What that means is the US government has to file with the Federal Court by approximately February 9, 2017.

So long as we are working toward a resolution, I will grant them additional time and not take a default. However, it is certainly a step in the right direction and a positive and historic day for the true San Pasqual Indians. I will keep you posted as we move forward.

Time to share the smoke and pray that JUSTICE, denied for a century, happens in CA.  NEVER GIVE UP, don't dishonor your ancestors by quitting.

Normal protocol by the Department. They need to try to mitigate before they litigate. The amount the BIA is being sued for is absurd. Don't assume they're going to bend over backwards for Natives. Never have, never will.
