MIWOK NATION Unsuccessful in Court Challenge to Theft Of Their Rancheria

Another chapter of the long-running battle between Cesar Caballero and the Shingle Springs Band of Miwok Indians has come to a close — this time with a fruitless ending.
In September, Caballero, the chief of what he claims to be the true Miwok tribe, sued the current tribal council members of the federally-recognized Shingle Springs Band of Miwok Indians tribe over control of the name and Shingle Springs Rancheria.

Despite a packed courthouse and highly anticipated hearing, El Dorado County Superior Court Judge Dylan Sullivan moved to dismiss the lawsuit during Jan. 24 proceedings.  Of course NARF was no help

As a state court judge, Sullivan said that she couldn’t act on the lawsuit because the Rancheria was granted to the tribe by the federal government through an Act of Congress — a statute the law doesn’t allow her to overrule.


The room grew intense at times during pre-hearing testimony, with about two dozen members of Miwok Nation, Caballero’s tribe, in the gallery. Representing Caballero, attorney Herman Franck said the Miwok people have been disenfranchised and robbed by the current tribal council.
“The folks who have taken over this land are imposters, they are frauds,” he said. “They should not be allowed to exclude true Miwoks.”
He continued, charging that the tribe’s actions are unlawful. “To me, it’s a theft. Like a theft of property. It’s a theft of a whole rancheria.”
At the core of the lawsuit is a debate over the ethnic makeup of current tribe members.
The lawsuit alleges that “at no time did the Miwok people and/or the Miwok Tribal Government ever authorize or agree to allow its sovereign operations to be somehow operated and controlled by Taino people.”

Quite confused on why this effort was made in California superior court. Is this case Caballero v Shingle Springs? I'll have to pull the pleadings.

I wonder what tribe that would be? To the best of my knowledge this man is a one-man tribe. Trying to steal good Indians names and their businesses. He use shingle Springs band name and claimed he was the rightful chief in order to get contract work with people. This guys a real clown. Why anybody would listen to him I will never know! He abuses the Salmon Distribution program. Point blank. He’s a felon. And a fraud. I think he lives in a world of the own where he’s big cheese, And all the other Indians drop around him like flies catering to his fat ego. Stop exploiting the natives man. Go back to San Diego where you belong you clown

Taino people? This guy swears he knows everything about the shingle Springs Indians and everyone else too. He tried to gain entry into my tribe but without success.He also he was a tribal police that could venture to any Rez in Cali. He said he could go anywhere he wanted on any tribal land. I told him he’d get kicked in his fat Backside and they’d send him packing. Now he’s holed up in DQ in Davis. I guess he got ran out of El Dorado. He told me that any Indian was welcome there as long as they showed him their tribal ID. I told him what gives you the authority to ask for anybody’s Tribal ID when you don’t even have one yourself!? LOL. This guys a joke. That is my opinion anyway

This man is not even federally recognized and has no business in Indian country whatsoever. All his court cases seem to be fraudulent. That’s my opinion of this clown. Guess the Indians weren’t as stupid as he predicted huh?

PS. He swore to me that he prevailed over the shingle Springs band. He said he whipped them. He said any day he would be handed over the keys to the Kingdom meaning Tribal operations in the casino. This is what happens when you get too arrogant

Just a humble opinion here. How could he be stripped of any tribal membership when he’s never been federally recognized in any tribe ever?

@Cheryln I am curious exactly which tribe it is that you are from? You seem to spend a lot of time and energy fighting your actual relative in defense of kanaka imposters?

Hawaiians intermarried into that tribe. They have Hawaiian blood. So what? They’re still Native!
