BIA's Michael Black REFUSES Rep. Mary Bono Mack's Request to Look into Disenrollments at Pechanga

Here is a letter from the worthless BIA which is a reply to Rep. Mary Bono Mack's request to look into the situation.




Notice the weaselly language from Michael Black.  What he doesn't say is that the BIA could use it's bully pulpit to say, "We know these violations of civil rights are egregious, but with no enforcement properties in the Indian Civil Rights Act, we are powerless."  Or,  "We have seen all documents and know that disenrolled members have been wrongly terminated."  Or "the Pechanga Band of Luiseno Indians, which has replaced the Federally recognized Temecula Band of Luiseno Indians, without going through the recognition process is free to terminate Native Americans with impugnity.."    

Amazing what cowards bureaucrats are.

Thanks to Mary Bono Mack for making the inquiry. We should be sending follow up letters to our congressmen to keep them aware.

I agree that "It has long been held by the courts that an Indian tribe has the right to self-government, and the right to determine its own membership"

But what happens when the ruling body of the Tribe (the General Membership) has determined that a Family or group of people should remain in the Tribe and not to be disenrolled. Not only this but also to remove disenrollment from Tribal law, And a small group of people who just happen to be in power decide to ignore those lawfully voted directives, and go ahead and disenroll anyways.

So here we have the governing body of the Tribe (the General Membership) exercising its right to determine its own membership, and the Council rejecting a lawfully voted upon directive from the General Membership.

as i read this the B.I.A. says (It is the Band's inherent right to determine its own membership in accordance withits tribal law.)did Pechanga follow its tribal law on the hunters dienrollment?.

No, they did not. The tribal membership halted all disenrollment. The council did not follow tribal law.

It looks like federal policy is to protect the tribal officials, not individual tribal members when it comes to tribal membership and disenrollment issues. It will take a lot of publicity and public outrage to get members of congress to consider legislative changes.

Rep. Mary Bono Mack should use this weak response from BIA's Michael Black to join with Rep. Mike Thompson and ask Darrell Issa for an oversight hearing into the Indian Civil Rights Acts.

At these hearings, she can point out how the BIA takes the easy way out.

It's NOT okay for government work.

I'd guess the writer of the above comment is one of the uneducated tribal members who doesn't know who members of Congress are.

It's okay, eyes are being opened, word is getting out, even the local politcians will be hiding out from the fallout.

Yes, they are all "Cowards!" But you have got to know that they "Will Not Bite The Hand That Feeds Them!" Why would they? I've said this over and over again: There Is No Money In Helping The Oppressed Native American Indian!" They know exactly what is going on and choose not to "Venture In!" Can't make the "Casino Indians" mad, for it wouldn't be in their best interest. But what is fair and just for the "Oppressed Native American?" Surely a look at the "Indescretions" of these "Corrupt Tribal Leaders" is in order from the "Government(Indian Affairs), but we all know that this won't be happening anytime soon. They back every "Illegal Act" that these "Tribal Leaders" put forth, and use "Sovereignty" as their "Tool" of choice. You know darn well that they could champion a revision to the I.C.R.A. to include "Enforement Provisions" against any and all "Illegal Endeavors" perpetrated against "Native Americans" in their charge by these "Corrupt Tribal Leaders!" They could also instigate "Sanctions," but we all remember the "Okey Doke" from the B.I.A at the "Tribal Leaders Conference" on proposed "Sanctions: Didn't Happen!" What about the "Senate On Indian Affairs?".... "Blind Eye" to "Human Rights Violations" which is so "Blatant in Indian Country" that it has to Vertually "Slap Them In The Face" for them not to see. So they choice "Not to Play!" This is:........ "Inexcuseable!"

Mary Bono Mack should not take "no" as an answer. She should use her authority to investigate further.

The BIA doesn't want to think out of the box, or lift a finger if it doesn't have to.

Join with Mike Thompson and ask other CA representatives to join you, Mary.

Dear Rep. Mary Bono Mack,

with all due respect to your effort to actually write a letter to the B.I.A., you need to do more. If you are serious and honest about helping then we suggest that you and other members in Congress actually meet and find a way to put teeth into the Indian Civil Right Act.
You as well as Us, we know that the B.I.A. has a long history of leadership corruption, being bribed by corrupt tribal leaders and their attorneys who pay millions of dollars in casino money to a willing and looking the other way Congress.
How about it Rep.Bono Mack?

Michel Black is quick to point out what B.I.A. can’t do. but what of the things they are responsible for. Like the Leyva line that came about thought fraud and forgery in the Riverside B.I.A... It is the B.I.A. responsibility and obligation to uphold the law. In the mid 70 Irene Scearce was caught changing the Leyva blood quantum. She was not prosecuted or fired only moved to another dept in the B.I.A... At this same time Vincent Ibanez and Edd Burbee were down there with Irene changing stuff. By the B.I.A.s incompetents on matters like this they have given power on this disenrollment. So Mr. Black is you going to fix your end of this and remove theLeyva line as Native Americans this is all in the B.I.A...

Mack has made no promises. She's simply doing her job as a congresswoman and standing up for her constituents.

It's to be determined whether she stands up more for what is right and just, or for a casino tribe that can contribute to her.

Do you really think Mary Bono Mack cares that much about this issue or was this just an attempt to now be able to say I did everything I could? I personally don't know where she stands on the issue so I am curious.

You should write Darrell and Mary and tell them what you think they should bring up.

Tell them there are three or four of you who are standing up for the hundreds who are lazy asses.

Actually I know of at least 15 people who are regularily speaking up for us here or are actively involved in our cause but your point is taken about the few standing up for the many who have been wronged.

However, even if it was just one person speaking out, our representatives in congress need to bring those issues to light.

I was speaking about 15 from Pechanga but you are right, we need more people to get involved.

there are others from other tribes we have been working with for several years now who are also involved.

For on thing she never asked us to come back, but we have tried to get an audience with the B.I.A over the supposed "Sanctions" that they say the "Could Impose" on these "Criminal Tribal Leaders." Letter, fax's, and the like to no avail. So in effect "Hammered!" They ignore us at every step of the way. We have sent "Suggestion" for "Sanctions,"...."But,Alas, They Won't Bite The Hand That Feeds Them." So you don't really know what we've tried to accomplish, do you? If you are one of us,..."Get Involved!" If not, Well....

Did Pechanga follow its Tribal Law on the Hunters Disenrollment?......."Now that would a "No!" They Disenrolled us a year after voting into our "Constitution"...."No Disenrollments!" We all know where "Mark Macarro" stands with his statement of: "Oh, That Silly Little Constitution!" So as you can plainly see: It's all about "Greed and Self Interest" with these "Corrupt and Criminal Tribal Leaders!" For "Heritage and Birthright" be "Damned," just their "In-sash-ious quest to line their "Pocketbook!"
