9th Circuit Hears Agua Caliente Tribe of Cupeno v. Michael Black (BIA)

Our friends at PALA WATCH had this video up last week, while I was on vacation and couldn't get to it from the computer available. Remember when the BIA director's NIECE Sara Dutschke Setshwaelo threatened the tribal attorney for the Cupeno?

Attorney Andrew Twietmeyer does a great job presenting the case and 2 of the 3 judges were well informed of the issues. The 3rd judge may have been playing video games on his IPAD.  Very interesting points, the opposing attorney's circular argument made no sense.

By approving the PBMI Constitution without any of the BIA’s recommended changes, and without any evidence that the BIA’s recommended changes were even presented to the PBMI General Council for a vote, the BIA abdicated and failed in its trust responsibility to the Indians of the PBMI—including the Agua Caliente CupeƱo

Still no proof that Sara Setshwaelo is the approved tribal attorney for PBMI. Somehow the requirement for BIA approval for attorneys as stipulated in the PBMI Constitution is never enforced. Maybe it doesn't matter. This video says PBMI is an association and not a tribe. Can an association have a tribal attorney?
