Bureau of Indian Affairs Says: "There Was NO Evidence Provided to Support The Disenrollment of These Individuals"

We have for our readers, a letter from the Acting Regional Director of the Bureau of Indian Affairs Dale Risling that shows that Robert Smith disenrolled Pala Members without evidence.

Is that a criminal act?

Robert Smith and the EC think they are above every power because they say they are sovereign. They are not the tribe is. Disenrolling without evidence and without even a reason given is a violation of the disenrolled civil rights and a clear violation of pala constitution. Not only did he disentoll with no evidence he held a "special meeting" last week ( no decendents ( even those still enrolled) of MB were even aware of the meeting to be able yo attend) and held a vote to make the disenrollments final. Umm excuse me didn't you tell the disenrolled they had to file an appeal with the BiA within 30 days which they did. Then you hold a meeting and state in a letter to the disenrollled since the BiA hasn't rendered a recommendation and it has been
4 months you Are making it final. Another clear violation of their rights and your power. It is not the disenrolleds fault rhe BIA didn't have recommendation handed down yet. Pretty funny though a certified letter to disenrolled was delivered yesterday and today the BIA decision was received by disenrolled!!!! Is the BIA working with Pala??? Pala has clearly violated the civil rights and offered no due process and it was their job to hold Pala accountable. Didn't happen bullshit is what it is too many corrupt people involved in this. We have shown the proof to Pala, the BIA ( who agrees with us) and those on OP and tv and still nothing is done to correct it. This is not the end don't think it is we will fight for what is right until it is fixed. Smith you may think this is over but you are wrong it is just now beginning.

Because clearly the BIA is stating they are not getting involved?

It does state your part of the pala tribe but, it also states they can't do anything?

For your information, my handle here, 'aamokat, means Hunter in the Luiseno dialect and as many of you know I have been commenting since this blog started, I have been writing letters to my representatives, I have attended Native American caucus meetings to lobby for our rights, and, among other things, what I have written has been featured on the homepage here at the O.P. Blog many times.

It is a safe bet that my ties to the Pechanga tribe are because I am a member of the 'aamokat (Hunter) family.

So who is quitting? Not me and certainly not our cousin, Original Pechanga.

HUnter ran site, Hunter and Apish assembled the last news coverage, putting themselves at risk by talking to the media. Many are working behind the scenes writing congress, Dateline 60 mins, etc. No true Native is ever giving up on their ancestors. Thats the way these impostors think. Thanks for getting the news story put together hopefully more news stations will want to do stories on disenrollments and bring it to the public. I wish dateline or one of the big news agencies would take this across the US. Keep fighting for what is right pechanga and pala disenrolled!!!

Actaully Pala's Constitution clearly defines how our membership is determined. It is determined by direct lineal decent from the 1913 Allotment Rolls compiled by the Department of the Interior. One must be a direct lineal decent and at least 1/16 "Pala" blood.

Our original Ordinance No. 1 gave the BIA final authority over appeals decision. The Executive Committee/Enrollment Committee changed our enrollment ordinance to say the BIA can only offer a recommendation.

However, by changing our blood degree the Enrollment Committee is in effect altering the 1913 rolls. They are also reversing a long standing final decision made by the BIA in 1989 which determined once and for all that Margarita Brittain is full blood Kupa.

The statute of limitations has long since run out on the 1989 decision and no new evidence was offered.

The BIA could in fact do something. But so far they choose to do nothing hoping all 162 of us disenrolled will go away.

We are not going away - ever.

The BIA will eventually be compelled to act.

Pala's enrollment committee cannot change who we are as a people.

They actually do have the authority. So far they are choosing not to act on it. It's not a foregone conclusion but I feel pretty confident that eventually they will be compelled to act.

I am not going to go into any details. All I can say is stay tuned...and it may take some time.

It funny how a tribal council can change a constitution and not allow the people to vote on any of the changes. Then they can make deadlines and not tell the people who are appelling a decision. Could u imagine if Pechanga had to Re-enroll the wrongfully dis-enrolled with back pay it would be over $400 million it would break the tribe...but then it is the tribes fault for illegally dis-enrolling them. PALA should re-enroll now before this goes on longer cuz when this goes to court and they rule to re-enroll with back pay Pala is gonna be paying too. If Pala was smart they would cut their loses now..but Robert thinks he's untouchable..u think his lawyer Dickstien would give him good advice and tell him.

With all the evidence in favor of the dis-enrolled and the ZERO EVIDENCE Robert has any court would rule in favor of the dis-enrolled! I mean even the BIA has said Pala EC has provided NO EVIDENCE to support their dis-enrollments! How stupid is Robert and the EC? So say another chairman was elected..can he re-enroll this family and then dis-enroll another family that did him wrong? How is that possible, isn't there laws or a constitution they have to follow to prevent this like the President has to? I mean if every President of the U.S. was allowed to do whatever he wanted the country would be a mess and change every 4-8 years. That's why there is a constitution to stop things like this no matter who is in charge.

Amy the RD, approved the "new" enrollment ordinance on July 22, 2009 that smith and his 27 quorum cronies SNUCK IN. Sara, also Amy's niece, the lawyer who the disenrollees actually helped pay for, led smith and the EC through this 4 to 5 year banishment process. How convenient and strategic it is that Amy did not sign the recommendation letter back to the appellants. It almost makes you think possible conspiracy, collusion, and conflict of interest.

The BIA is able to step in and pull funding from the tribe if they violate their constitution or do not offer due process to their members all which has has been proven in the appeals and supplement appeals to tr BIA yet they still offer no help to the disenrolled. They know Pala is violating the rights of the disenrolled they are not following their own constitution by deciding membership by using the 1913 allotment roll, they gave NO reason at all for disenrollment, they violated the savings clause, told the disenrolled to appeal to the BIA then didn't even wait for the BIA response before holding a meeting and making it final. This is just a fraction of rhe violations the BIA had the authority to act upon and did not. Like the person above said it is complicates if you read other comments from here and OP you will better understand or read the appeal and supplement appeals of the disenrolled you can find online. You should read the appeals and supplements it is black and white the BIA should have acted upon this.

You have a family who has a documented right to be enrolled(MB family).it's all there on paper,even the BIA says they should be enrolled!
You have another family where it is documented doesn't have the blood to be enrolled(admitted by elders of family more than once.(rocindas family).the BIA says they don't have blood anymore!
Now I see why people like Doreen and Mel don't agree with the BIA,the BIA ruled against them twice.Once when they lowered their blood(everyone knows Yaqui blood is not native to the united states!)
Then the BIA restored MB blood,well Yaqui Mel made a claim rosinda told him MB was only half!
That claim goes against sworn testimony from people who knew and lived with MB.
This mess is getting clearer and clearer!

Those of us who know Robert Smith, who grew up with him and saw the tragic childhood, from the hateful beginning of an innocent child being thrust into a miserable existence, with two welfare minded parents (can you say government cheese) who spent as much of their time eating as drinking (with the exception of hating); never providing a proper loving environment and perhaps instead breeding hatred towards those who did work hard to provide a proper upbringing for their children because they miserably failed at that. I don't recall Victor or Marie ever doing anything except inflicting pain upon their children because of their miserable deficiencies as parents, and because hate breeds hate, that is why MB decendants are in this predicament. Those of us who saw Robert grow into a young man began to see the monster began to emerge. As this victim of his own upbringing began to show the monster that would become Pala's most hateful and horrible leader, saw the monster develop his skills as a party loving (alcohol and highballs) bully/monster. Keep the cocaine flowing and the Limousines rolling. Mix in a little rape here and a little drug dealing there and your monster starts to emerge into young adulthood. I see you, robert smith, I know you and you can't fool me. Soon, you pair this failure of a human being up with a greedy, like minded lawyer and with time you create the perfect team of corruption. Using sovereignty to now rape the people, taking away the citizenship of anyone who threatens their little racket, its tragic how none of us saw this coming, but if you know Dicksteins prior actions with other tribes, then you'll understand this as nothing more than Dickstein's usual modus operandi. Smith, unfortunately, is too dumb to know how to execute this plan, he is limited to bullying and threatening, but with Dickstein at the reins, the beginning of taking away the citizenship of rightful descendants now can fully commence. On the other hand, color coded ballots, open access to ballot boxes, no verification of counts, and RS in Vegas at election time telling people he's got it in the bag, are typical of the current election process in Pala.

Nona and Eric both know what they did. They enabled certain events to occur and, in some cases, blocked events from happening. They are enablers. If you dig into their finances, would you find pay offs, or look at their salaries, would you find they are paid 3x, 5x or 10x above the normal rate? It is so sad that money can rule peoples conscience. For people to turn on their own famliy members because of money is just awful. Their ancestors must be looking down and frowning in disbelief and feeling betrayedthat they would behave that way. I would be afraid of the evil that would come my way from doing such a thing. Robert Smith should really be afraid of what the spirits of his and our ancestors will do to him for doing this to their tribe. I am glad I am not in his shoes. I hope they have mercy on his soul and send help his way to make him a better person and to help make to overcome the evil he is doing to himself.
