We received a letter that is being circulated to Congress and the Department of Interior and BIA.   Please send a copy to Congress, and of course, if your tribe is not represented, add a paragraph.

Honorable Congressperson

I am writing to you for your assistance and your involvement to step in on behalf of hundreds of individuals throughout Indian Country. Many gaming tribes are committing criminal and civil crimes and then hiding behind the blanket of "sovereignty" all while congress allows them this power. The most recent incident occurred when the Pala Tribal Council (southern California) disenrolled 134 members against the recommendation of the B.I.A. whom had already informed the Tribal Council that the individuals in question provided documentation to prove rightful enrollment into the tribe. The tribal council refused, ignored and unjustly disenrolled these individuals, going as far as removing these families from their homes on the reservation; these families have never lived off of the reservation and are presently homeless and destitute.
Prior to Pala's Tribal Councils actions, Pechanga Tribal council allowed the disenrollment of two families; 230 members not counting children. When one of the families, the Hunter’s was being investigated Pechanga hired Dr. John Johnson a renowned anthropologist from Santa Barbara to dispute the documentation the Hunters had. Dr. John Johnson's findings did the opposite; his report only verified and even added more documentation and factual information to prove them to be rightful tribal members. Pechanga's enrollment committee, during their disenrollment proceedings decided not to use his report and disenroll this family with no factual documentation only hearsay, Jointly the Tribal Council and enrollment committee went as far as overruling the general memberships vote to put a stop to all disenrollment including that of the Hunters.
As of as recent as April the Pechanga tribe has been dealing and covering RICO act violations and discussion of money laundering and embezzlement, committed by Jennie, Larry, Anthony, Andrew and Raymond Miranda all were found to have purchased slot machines illegally and illegally sold them. This family has held positions of power serving on the tribal council, the gaming commission and the Pechanga Development Corporation. Please be aware that this is the start of a new type of organized criminal organization. Because of sovereignty congress is to a degree giving their "blessing" to this activity by ignoring numerous violations and illegal activity. The Tribal Councils involved fear of wielding sovereignty like a sword to destroy anything or anyone that will get in the way of their agendas, legal or not. There is no concern for the individuals or the tribe as a whole.
Another example is that of San Pasqual where individuals have the opportunity to file a final appeal with the B.I.A., the B.I.A. reviewed the case and decided to rule in favor of those disenrolled, Mr. Larry Echohawk overturned the decision, in turn this was appealed in a court of law, the ruling again found in favor of the disenrolled whom were to be reinstated as members of the tribe with all benefits returned to these individuals, again Mr. Echohawk overstepped his authority and directed the tribal council to deny the benefits to these individuals, interestingly the court's ruling had found Mr. Echohawk's decision to be biased. The Tribal Council knows they are ordered to reinstate these persons but refuses to do so. To be noted is the fact that Mr. Echohawk has resigned from his position. The BIA has a legal responsibility to fix this.
As my congress person I demand you have the B.I.A. enforce, The Commissioner of Indian Affairs Delegation of Authority Regarding Tribal Enactments section 18. If the tribes do not follow the outcome then all federal funding should be cut off until the tribe does so. I would not like to see the beginning of a new criminal organization when congress should have stepped in to prevent this. November 18, 1895: "It cannot be possible that in any portion of this country, government, no matter what its origin, can remain peaceably for any length of time in the hands of one-fifth of the people subject to its laws. Sooner or later, violence, if nothing else, will put an end to a state of affairs so abhorrent to the spirit of our institutions. But these governments are of our own creation, and rest for their very being on authority granted by the United States, who are therefore responsible for their character. It is bound by constitutional obligations to see to it that government everywhere within its jurisdiction rests on the consent of the governed. There is already painful evidence that in some parts of the territory, this attempt of a fraction to dictate terms to the whole has already reached its limit, and, if left without interference, will break up in revolution." ~~From
Report to Congress of the condition of affairs in the Indian Territory... on the manner in which the citizenship of said tribes was dealt with, finding a deplorable state of affairs and the general prevalence of misrule.

And I bet any US Official tries to give you some BS about how they didn't know this would happen in Indian Country.

"The Commission is of the opinion that if citizenship is left, without control or supervision, to the absolute determination of the tribal authorities, with power to de-citizenize at will, the greatest injustice will be perpetrated, and many good and law-abiding citizens reduced to beggary."

Sound familiar?

"There is no alternative left to the United States but to assume the responsibility for future conditions in this territory. It has created the forms of government which have brought about these results, and the continuance rests on its authority. Knowledge of how the power granted to govern themselves has been perverted takes away from the United States all justification for further delay. Insecurity of life and person and property increasing every day makes immediate action imperative."

1895 until 2012...what has changed?

Only the amount of "Greed and Self Interest" with no end in sight. "Heritage and Birthright" be "DAMNED!" Oh, things have gotten worse: "THE CASINO INDIAN!"..."Eagle Eyes."

You mean that the Greed and Self Interest is proportionate to the amount of money the Casino brings?

I meant...what has changed the United States government from their duty to intervene. The fact remains here in California as it did in 1895 when this report was written: The United States created these forms of government which brought about these results. The power granted to (the tribe) govern itself has been perverted. Members are living in a state of insecurity of life and person and property. The United States CAN STEP IN and SHOULD!

Santa Clara vs. Martinez was about the United States not setting membership criteria by changing the tribe's approved constitution. To pretend like it was about the power to de-citizenize at will has been grossly manipulated. Here in California it's the tribes not abiding by their federally approved constitution (perversion of law) in order to gain power/money/influence to cause members to be insecure and fearful.

The perversion of law in the hands of the "wrong" leaders was acknowledged 117 years ago. Obviously if this issue has existed that long the United States Government should be compelled to act (they assume responsibility in this Congressional report) and actually take steps to put an end to this problem by intervening in membership disputes.

With the recent Pala case and the Brittain's being deprived civil rights, due process, freedom of the press (NC Times has deleted comments on the Pala articles) and thanks to blogs like this one and more access to ancestral or historical documentation...I think now is the best time to pressure the US Government act on it's obligations to the members who are being forced into homelessness or who are still living in fear.

Thanks to this blog...we are all much better educated on issues.

As the per cap keeps shrinking due to lower revenue and more expenses(like many more contributions to elected officials to turn their back to the tribes wrong doing)..you are probably going to see more dis-enrollments.
The tribes are so worried that someone else in the State is going to get some of online gambling money, they are upping the contributions to politicians.I think the State should cut them out of the online gambling, they already have the monopoly of the Casinos...

And you think this is going to happen: "?????." They haven't, really been, exactly, "Forth Coming" with their "Obligation" that you "Speak Of?"..."Reality Check:" Doesn't look to good: "Does It? Tell me, when has the "Government(Indian Affairs)" given a "Tinkers Damn" for the rights of the "Oppressed Native American Indian?" Again, "Reality Check:" They haven't. Oh I agree they have the "Ability and Means" to intervene on our behalf, but backing these "Corrupt and Criminal Tribal Leaders" seems to be "What they do best."..."Eagle Eyes."

Sorry Smokeybear all this is still new to me. I feel homelessness soon and look at my children and am severely grieved. I didn't grow up in this but am now connected as a parent. I've seen the lies and misleading firsthand and deep down I don't understand how someone can flat out lie to their people, the public, and to the government and how the government just let them. Or how the people can know how wrong it is but be so fearful they won't stand to protect themselves. I'm most disappointed in the US Government for every call I've made to be overlooked as if the life and history of a citizen is so unimportant.

"Greed and Self interest" is the main reason these "Criminals" do what they do, and until the "Government(Indian Affairs) gets their "Inclusive Heads Out Of their A..'s, these "Corrupt Tribal Leaders" will continue with their "Treasonous Acts" against their own. But don't, even, give up. Keep the pressure on these "Parasites," we will "Overcome!"..."Eagle Eyes."

Oh, they know, exactly, what's going down in "Indian Country," but there is no "$$$$" in helping the "Oppressed!"...."Eagle Eyes."
