California Governor Jerry Brown Gives Standing to ALL California Indians! Establishes Tribal Advisor Position

THANK YOU Governor Brown, for recognizing the struggles of Indians that have been harmed by corrupt tribes throughout the state.  In his Executive order below, Governor Brown has given standing to all California Indians.   From the Governor's press release: 

For purposes of this Order, the terms “Tribe,” “California Indian Tribe”, and “tribal” include all Federally Recognized Tribes and other California Native Americans.


There are THOUSANDS of disenfranchised Native Americans in California.  Those who have had their citizenship stripped from them, and many who are not allowed their rightful place in tribes due to moratoriums on citizenship.   The American Indian Rights and Resources Organization  represents this group which, if a recognized tribe, would be the second-largest in California, tripling the size of Pechanga, which practices apartheid on their reservation, ten times the size of Redding Rancheria and six times the size of the Picayune Rancheria.

What are the chances gaming tribes will be lobbying Gov. Brown to now strip California Natives not represented by tribes who contribute to our state politicians, of rights he just granted in his executive order?



PRESS RELEASE.

SACRAMENTO – In order to strengthen communication and collaboration between California state government and Native American Tribes, Governor Edmund G. Brown Jr. today issued an Executive Order establishing the position of Governor’s Tribal Advisor in the Office of the Governor. This position will serve as a direct link between the Governor’s Office and tribal governments on matters including legislation, policy and regulation. Governor Brown signed the Executive Order today while attending the TASIN All California Tribes Meeting at the Sheraton Hotel in Sacramento, CA.

The text of the Executive Order is below:

EXECUTIVE ORDER B-10-11

9-19-2011
WHEREAS California is home to many Native American Tribes with whom the State of California has an important relationship, as set forth and affirmed in state and federal law; and


WHEREAS the State of California recognizes and reaffirms the inherent right of these Tribes to exercise sovereign authority over their members and territory; and


WHEREAS the State and the Tribes are better able to adopt and implement mutually-beneficial policies when they cooperate and engage in meaningful consultation; and


WHEREAS the State is committed to strengthening and sustaining effective government-to-government relationships between the State and the Tribes by identifying areas of mutual concern and working to develop partnerships and consensus; and

WHEREAS tribal people, as both citizens of California and their respective sovereign nations, have a shared interest in creating increased opportunities for all California citizens.

 NOW, THEREFORE, I, EDMUND G. BROWN JR., Governor of the State of California, by virtue of the power vested in me by the Constitution and the statutes of the State of California, do hereby issue the following orders to become effective immediately:


IT IS ORDERED that the position of Governor’s Tribal Advisor shall exist within the Office of the Governor;

IT IS FURTHER ORDERED that the Governor’s Tribal Advisor shall oversee and implement effective government-to-government consultation between my Administration and Tribes on policies that affect California tribal communities, and shall:

 • Serve as a direct link between the Tribes and the Governor of the State of California.

 • Facilitate communication and consultations between the Tribes, the Office of the Governor, state agencies, and agency tribal liaisons.

 • Review state legislation and regulations affecting Tribes and make recommendations on these proposals.


IT IS FUTHER ORDERED that the Office of the Governor shall meet regularly with the elected officials of California Indian Tribes to discuss state policies that may affect tribal communities.

IT IS FURTHER ORDERED that it is the policy of this Administration that every state agency and department subject to my executive control shall encourage communication and consultation with California Indian Tribes. Agencies and departments shall permit elected officials and other representatives of tribal governments to provide meaningful input into the development of legislation, regulations, rules, and policies on matters that may affect tribal communities.


For purposes of this Order, the terms “Tribe,” “California Indian Tribe”, and “tribal” include all Federally Recognized Tribes and other California Native Americans.


This Executive Order is not intended to create, and does not create, any rights or benefits, whether substantive or procedural, or enforceable at law or in equity, against the State of California or its agencies, departments, entities, officers, employees, or any other person.

 I FURTHER DIRECT that as soon as hereafter possible, this Order shall be filed with the Office of the Secretary of State and that it be given widespread publicity and notice.

 hand and caused the Great Seal of the State of California to be affixed this 19th day of September 2011.

I'd like to think that Gov. Brown, who has taken tens of thousands of dollars from tribes, is still looking out for those that really need it.

I don't believe it, and think this was a mistake, but it would still be nice.

Does he have to issue a new exective order to strip the standing he has given us?

Even if in error,it gives AIRRO a chance to represent our interests.

It forces the state to be public about their refusal to meet. It shines a light on their activity.

O.K., show mw where this little exercise in Tribal to Government(State) relations is going to help the "Oppressed Native Ameican?" Is Human and Civil rights Violations "Ever" going to be a topic of grave "Concern" to the "White Man," A.K.A. Jerry Brown? This "Execetive Order" that Brown has put forth has no meat or substance to address sovereighty as a tool of the "Casino Indians" quest to eradicate "True Native Americans" illegally from their respective memberships. So I ask you, "Where is he going with this?" It's all about the "Money," and how can California benefit by being in bed with these "Criminal Tribal Leaders!" It falls in the same catagory as the "Indian Civil Rights Act!" "No Substance!" In law, "TREASON" is the crime that covers some of the more serious acts of betrayal of one's sovereign or nation. Deceitful, Corrupt,and Greedy Tribal Leaders practice "Treasonous Acts" against their own, because they "Can!" With "Brown" venturing into the world of "Indian Relations" he will routinely side with the "Casino Indian," as does the Government (Indian Affairs), because, as we've all seen, "There is no "Money" in helpng Illegally Disenrolled/Banished Native Americans! I ask you, where is it written that this "Execetive Order" will allow "Brown and the State of California" to go after "Criminal Elements" that exist within Californias' Tribal Nations? It does"t, and they "WON'T" even venture into that "Can Of Worms!" You "Hide and Watch" what transpires with this little venture, because "Corruption is, as Corruption does!" We all know that Californa has "Money" touble, and if "Brown" can squeese more from the Corrupt Tribal Leaders, he "Will" and the "Oppressed Native Ameican" be "DAMNED!" Smokey asks some good questions. But I ask a question in return.

If we dont' try all avenues, do we just give up?

Standing would seem to give us a bit of an edge that we didn't have before: recognition by a sitting governor that the individual Indian has rights.

Or, one could just rant here on a blog, which is akin to howling at the wind if it's the only outlet.

Courts will/can respond to standing. And we can also trumpet the fact to the press and legislators. It certainly is not a magic bullet, there isn't one. We must accept all positive actions.

This was an act designed to outreach to tribal governments,and we have a bit of luck to be included. NOW, Brown has some choices, he can let the EO stand as is,or he can strip the Native Americans who most need the governments help of their respect.

Do we rant only? Or use all avenues?

It does NOT "mean nothing." Trojan; "mean nothing;" carries with it many disastrous implications for victims of criminal acts by tribal
'governments.'

It purposely vague to benefit lawless acts by those committing criminal acts using veil of 'sovereignty.'

Interesting to note 'cozy' relationship between Brown and Pechanga,and other 'friends.'

Does this remind anyone of the days of old when the Government gave us "Indian Agents," ("with no due process to fight the wrongs perpetrated against "Native American Indians") and allowed them free rane to "Steal, Cheat, and even Murder, our people with the Governments "Blessing!" So excuse me for being just a little cynical of Brown's" Executive Order!" Don't get me wrong, I'm all for any and all avenues of justice that would bring an end to these "Treasonous Acts" against our people, but by what means? Do you, realistically, think that they(Brown and his Cohorts) are even going to venture into Human and Civil Rights Violations? Why would they? There is no "Money" in it. And, again, why would they bite the hand that feeds them? That's what the Indian Civil Rights Act was all about: Make recomendations only. No power to stop the "Travisty" of Disenrollments/Banishments! Not forcing the "Casino Indians" into following the Constitution and By laws in their respective memberships. You have to get an interview with the govener then have him send a request to DC is what I was told when I visited in Sacramento. I have sent letters and files to DC to the DOI never got a return answer! About reclassification of lineal members and dis-enrollment process by tribal councils saying your not a member because your grandmother wasn't from the area or some other lame excuse.

I thought you were suppose to be atleast 1/4 to hold office who is enforcing that law? No one that I know of BIA don't give a **** just as long as they get their off the top cut before taxes and expenses from the Casino's.

Before the advent of the Casino we all lived in "Harmony." With the Constitutions and Bylaws being the "Law," problems could always be resolved for the good of their respective Memberships. Not always exactly right for all involved, but usually good enough. Now comes Greed and Corruption and the Criminal Element, and Honesty, Justice, and Fair Play no longer exists. Ironic that even after they kicked us the Hunters to the curb, Pechanga reportedly may still be claiming our numbers to get cheaper health insurance rates for tribal members.

A Hunter family elder gets insurance letters from the insurance company when she gets treatment that says the insurance company is not going to pay for the treatment.

She tells her doctor she doesn't have insurance and she doesn't attempt to use insurance so why is she getting claim letters from the insurance company, the one that she had insurance with when she was a tribal member?
