You Want PROOF the Trask Family of San Pasqual Doesn't Belong?

Well, of course there is oral history, but some tribes are so well documented that it could fill a binder, or two, or in the case of San Pasqual and the Trask family SEVENTEEN BINDERS!

BIA says tribes have the power to control their enrollment issue. But I believe the issue is not enrollment. These people had enrollment status first and what happens second is an unconstitutional and lawless event takes place that results in dis enrollment. Why can't BIA look at the lawless act that took place and not the injuries (meaning dis enrollments). BIA would not be meddling in ENROLLMENT BIA would be addressing "constitutional violations". The dis enrolled need lawyers to step up and " manhandle " the BIA. Something has to give.

The enrollment of the Trask family is not under review by the BIA. Proving the Trasks don't meet the eligibility requirements won't reverse the disenrollments. It does show that the eligibility requirements are being applied selectively. It could show bias and discrimination. It could be evidence that civil rights have been abused.

The BIA can only decide on the matters brought before them. The BIA cannot address "constitutional violations" because the BIA has no jurisdiction over internal tribal affairs. Even though the BIA has the authority to rule on enrollment at San Pasqual, they have consistently deferred to the right of tribes to determine their own membership, and they are trying very hard not to meddle in enrollment issues.

By now it is very clear that the BIA supports disenrollments. It is not just protecting the right of a tribe to determine its own membership. If the BIA was only adhering to the Santa Clara Pueblos v. Martinez decision, they would state that they disagree with tribal leaders who disenroll legitimate tribal members, but are constrained from interference. They would include in their decisions that disenrolled tribal members are entitled to due process, and equal protection under the law, and require that tribal leaders respect the rights of disenrollees.

Instead they give deference to corrupt tribal leaders, they accept the interpretations of tribal law given by tribal leaders, they reject decisions made by the general membership, they look for laws, ordinances, and regulations that allow them to justify disenrollment orders. In every way they act as though individual members have no rights, no entitlement to benefits, and no just claim to land or assets.

The only way to combat the internal agenda of the BIA is to paint them into a corner. Force the BIA to base their decisions on federal law and not on tribal law. Federal law protects the rights of individuals. How do you do this? By making the BIA determine whether or not civil rights have been abused in the disenrollment process.

The Book has been written and the Bad Actors are being highlighted again. Come on Macarro et al, follow custom and tradition. Honor ALL Ancestors rights and ALL the good will flow easier. Start fixing the flaws that have been made under your own boat. Do good things inside, settle the liars club issues and honor ALL ANCESTORS and their heirs.

Tribes have the right to determine their own membership. If Tribal Members are upset they should probably first impeach him then work on the issue of disenrollment. Just my opinion

If tribal members don't determine membership, and members who disagree with councils and are threatened to be quite or your next. Bad actors share lies and misinform others to cover these acts. Corrupt factions say the tribe did these acts, however the band was taken over and custom and tradition was ignored. Macarro et. al

In the old days chiefs guided their people. Now chairmen polititions steal from them. Today they have smooth tonges to lead members astray. Their is no spirutuality to them, they truly have lost their ways. Their faith is in casino's and they listen to the jingaling of slot machines.
