Former RINCON HARRAH"S Resort GM in VALLEY CENTER SUES over COVID 19 Health Concerns

 Opening Tribal Casinos in CA may have led to one death from COVID 19. The County refuses to name businesses where they may have contacted the killer disease. Accordingly, just because the afflicted may have visited the casinos, it doesn't mean they contracted it there.  Pechanga has lost one member to Covid 19. The RINCON TRIBE owns Harrahs.

A top executive at Harrah’s Resort Southern California who quit the day before the casino reopened is suing his former employer, claiming he was forced to resign after management ignored his concerns that the decision was dangerous and could expose visitors to COVID-19.

Darrell Pilant, the Valley Center casino’s former general manager and senior vice president, filed the lawsuit against Caesars Entertainment Inc. in San Diego Superior Court on Monday. He alleges the company’s decision to reopen in May resulted in “serious adverse health and safety consequences involving employees and customers contracting COVID-19.” 

San Diego County confirmed to inewsource this week that 217 local residents who have contracted COVID-19 reported being at a casino within two weeks of becoming ill. Twelve of the people were hospitalized and one, a casino patron, died.

A 20 minute video from the RINCON people on recreating their base roll of membership giving an enrollment committee too much power and this enrollment committee is NOT applying the same rules for everyone.

The is an OPPOSITION to lifting the moratorium on membership.  Lifting the moratorium to these people, bringing more people in "would NOT benefit the Rincon band.




At 16 minute park, an argument on the Census rolls being incorrect. I agree, we SAW Pechanga's enrollment committee member FALSIFIED those documents while employed at the BIA.

Tribal Casino Crimewatch: Carjacking at Harrah's Rincon

Another carjacking at a tribal casino,no, not Pechanga, this time at Rincon.

A man armed with a handgun took the dark gray Ford Focus from the victim at 5:19 p.m. at Harrahs Rincon Casino , the Sheriff's Department said.

The carjacker was described as a Latino about 25 years old, about 5 feet 10 inches tall and about 180 pounds. He was wearing black clothing and was last seen heading south on North Calac Road.

Schwarzenegger a Political Blackmailer Says Rincon's Bo Mazzetti

Rincon Tribal Chairman Bo Mazzetti has an article up in Indian Country Today:


States and governors just can’t seem to control themselves; they cannot keep their hands out of tribal pockets. The concept that tribal governments have rights and financial needs has eluded them for so long they have become accustomed to ignoring them.

But occasionally a governor gets a hand slap for reaching too far into tribal pockets and breaching our sovereignty. An example is the Rincon Band of LuiseƱo Indians’ legal victory over former California Governor Arnold Schwarzenegger for illegal taxation and bad faith in renegotiating Rincon’s gaming compact.

The case affirms that occasionally tribes have the power to tip the imbalance of power states enjoy.

Schwarzenegger was a political blackmailer from the outset of his career as a California politician. He used tribes and gaming income as a wedge issue in his run for governor. It may not have been “playing the race card,” but it was a none-too-subtle “us versus them” strategy.

In an expensive television campaign, he asserted that the former governor’s deal with the gaming tribes had been too favorable to California Indians. He vowed that he make tribes pay their “fair share.” The backdrop for the campaign was the state’s continuing budget deficits and the voters’ “no new taxes” mentality.

Schwarzenegger found a painless solution for California voters: Tax the rich gaming Indians. It didn’t matter that most California tribes are far from rich—they’re actually closer to destitute—and only a few tribes earn big bucks through gaming.  OP:  That's because they try to keep tribes from getting casino's and becoming competitive.

Schwarzenegger carried out his promise to make tribes pay more. He accomplished that by renegotiating compacts or approving new compacts with tribes only when they agreed to be taxed at 15 percent and up to 25 percent of net win. Since there was no consideration of overhead and deductions for operations, a net win for the Rincon Band, asking to renegotiate to add 900 new slot machines, would have actually been a 30 to 40 percent tax.

BREAKING NEWS: SUPREME COURT REFUSES TO HEAR RINCON vs California Case

The U.S Supreme Court on Monday left intact a court of appeals opinion that will make it more difficult for states to hold out for certain payments from tribes who want to negotiate compacts to expand or build new casinos.

The court decided not to hear the California appeal by the Rincon Band of Luiseno Indians, a San Diego area tribe that wants to add slot machines to Harrah’s Rincon Casino & Resort.


By refusing to hear the case, the Supreme Court effectively upheld Rincon’s view that California went too far in its demands that general fund payments be made in exchange for the right to put hundreds of slots on the casino floor.


Tribes have been watching the case closely, saying the decision will have broad ramifications over compact negotiations between tribes and the governor.   EPIC FAIL on the part of Schwarzenegger

Rincon Tribe Barricades Private Property - Keeps Owners INSIDE

The Rincon Tribe is working to control privately owned land.  The landowner does not recognize tribal authority over his property. But it's a sign of things to come.   The Pechanga Tribe of Temecula is also working to steal/control water that was designated to allottees of the Temecula Band of Indians, who were granted land on the reservation that was set aside for ALL Temecula Indians.   A Splinter Group has taken control of the tribe and is trying to use their leverage with Congress to steal water rights.

The Rincon Band of Mission Indians placed three concrete barricades this week at the entrance to a neighboring property ---- the latest salvo in a 4-year-old battle to get the owner to comply with the Valley Center tribe's environmental regulations.

The 5-acre property, located directly across the road from the tribe's casino and resort, has housed a vehicle storage facility, trucking business and numerous recreational vehicles. Rincon officials have said the property was a health and environmental hazard and has ordered it to be cleaned up.
But the land that once was part of the reservation is now privately held by Marvin Donius, who says the property is not subject to the tribe's jurisdiction or laws.

The barriers blocked Steven Rogers-Dial and his wife inside the property. The couple rent a home on the property from Donius. Rogers said he was prepared to stay on the property as long as possible in solidarity with Donius.


"I'm not going to walk out just yet," Rogers said. "I've got enough food to hold me a month, if I need to."

Schwarzenegger's Dirty Pool Negotiations With Rincon Struck Down by US Appeals Court

Our governor, Arnold Schwarzenegger is AGAIN rebuked by California courts. His illegal taxing of Native American tribes was struck down by the Appeals court.

California can’t force Indian tribes to share gambling profits to repair the state’s budget problems, the 9th U.S. Circuit Court of Appeals said Tuesday.

In a stunning blow to Gov. Arnold Schwarzenegger’s tactics when dealing with tribes wanting casinos, a divided, three-judge panel of the appeals court said the governor can’t ask for money for the state’s general fund without offering something of value in return because that amounts to an illegal tax.

The court upheld a 2008 ruling by a federal judge in San Diego that the governor was playing dirty in his negotiations with North County’s Rincon Indian band.


There was dissent:

Dissenting Judge Jay Bybee said tribes with casinos here and around the country have agreed for years to share revenue with state governments, just as Schwarzenegger was seeking.

“The holding … does not just upset the apple cart — it derails the whole train,” Bybee wrote. “If the majority is correct, then there is nothing for California to do but to authorize whatever (slot machines) the band wants. The band wins. Everything.”

The state will seek to have Tuesday’s decision reviewed by a larger panel of 9th Circuit judges, said Jeff Macedo, a spokesman for Schwarzenegger


Tribes were WILLING to sign on to compacts to get gaming and expanded gaming. It's time to expand gaming in California outside of Tribal reservations.

Rincon Decision Could Change Compact Negotiations.

Rincon Chairman Bo Mazzetti has an article in Indian Country Today, arguing that our Governer, Arnold Schwarzenegger negotiated in bad faith with tribes. Well, the tribes also promised they would take care of their people. How did that work out for members of Pechanga, Picayune, Redding and many others in California? Disenrollment, elder abuse, loss of voting rights, healthcare...... By stacking the deck against tribal governments when negotiating casino compacts, California Gov. Arnold Schwarzenegger was gambling that he could violate federal law with impunity. He bet he could hold the tribes hostage by our need to engage in gaming as our only means to economic development. But, it appears this is one bet he may lose. OP: Tribes like Pechanga tried to circumvent laws too, like putting additional Class II slots trying to get around their 2000 slot limit. Mr. Mazetti falsely claims that gaming is the only means to economic development and that's not true, entertainment and dining, also have economic possibilities. Of course, one may make you rich, the other, simply a business venture. The United States District Court has ruled that the governor’s negotiation tactics with California’s gaming tribes are illegal and constitute bad faith. The state appealed to the 9th Circuit Appeals Court and a decision is expected soon that may change the way governors throughout the nation negotiate. It may also halt the trend of holding tribes hostage to state politics and charging increasingly higher fees as a condition for signing compacts. The lawsuit, brought by the Rincon Band of Luiseno Indians of San Diego, alleged Schwarzenegger imposed an illegal and unfair tax on gaming revenues in return for tribal state compact agreements. OP: If you want a monopoly, you should have to pay dearly for it. Otherwise, it would make more sense to change the laws and legalize gaming in California, with total regulation by the state. What a CONCEPT!

Rather than work with Rincon to reach an agreement consistent with the court’s order, what did the state do? The state appealed, until the case finally landed where it currently sits – pending the decision of the 9th Circuit Court. OP: The HORROR! After suing the state, Mr. Mazetti whines about the state suing back!?

New Laws Apply on Rincon Reservation

At the Rincon Indian Reservation, kids hang out all night getting into fights, people shoot guns in the streets and trespassers dump furniture, oil drums and puppies ---- all with relative impunity.

But that's changing. A new set of tribal codes that took effect July 1, along with a maturing tribal court system, may succeed in reining in the kind of behavior that most cities and counties have regulated with ordinances, tribal spokesperson Nikki Symington said."The reservations have gained a reputation for lawlessness, and it's been true," she said. "For the first time, we've got due process that protects individual rights while establishing community standards of behavior."The new laws mark the first time that the tribe has tried to legally enforce its own code of behavior, Symington said.

The Sheriff's Department provides law enforcement for Rincon, but deputies can enforce only the California criminal code.Those laws say little about such things as how late a loud party can run, refinements usually regulated by county and local ordinances.But now, with its own laws, police and court, the tribe can enforce a ban on undesirable acts, Symington said.A range of finesRincon's new laws, called the Peace and Security Ordinance, are a set of civil codes that establish fines for offenses such as vandalism, trespassing, curfew violations, drug use and loud parties.The codes apply to anyone on the 5,000-acre Valley Center reservation, including visitors, 300 tribal residents and 1,200 nontribal residents, she said.

The laws were developed to address problems involving residents and trespassers and won't affect most casino patrons, Symington said.Private security guards and sheriff's deputies will continue to enforce laws at Harrah's Rincon Casino, she said.
