The fallacies in this conversation with a young Temecula Indian is staggering. What are they teaching?   In the Pechanga disenrollments of two large families, disenrollment was done SPECIFICALLY to harm those who stood for justice.

BOTH families traced their ancestors back to Original Pechanga ancestors.
SOVEREIGNTY does NOT depend on a correct membership roll. The Feds will allow tribes to SELL memberships.  

The Pechanga Band of Luiseno Indians did not ACCEPT the proof their OWN documents and oral history laid out.

Disenrolling Tribes Please Come home to The NATIVE WAYS of Our Ancestors

 In over 13 years of fighting against tribal disenrollment, starting with the Pechanga disenrollments of two families, I’ve placed all of my time, energy and righteous anger on the nightmare of this paper genocide .
This scourge defames our ancestors, abuses our elders, and rips the heritage from our children. 

 For all of these years, I’ve neglected to speak about what it truly means to be an American Indian. Today, I want to briefly share my experience of the Native Way, with the beautiful native people of Northern New Mexico.

While driving from Upland, California to Chama, New Mexico to visit my brother, who had just relocated to the small New Mexican town, my wife and I experienced that community, and their actions touched me to my core.

I was trying so hard on that trip, to keep our Mazda CX-9 at the speed limit. It was unfamiliar territory and we were visiting in the dead of winter. There was this white stuff everywhere that this Californian was unfamiliar with. I'm certainly not used to driving through snow or ice, so I was trying to keep it safe by keeping under the 55 MPH speed limit.

East of Bloomfield, New Mexico passing the mile marker 102 sign, I crested a small rise, could not see the road, and quickly came across a herd of deer crossing the road.  I stood on my brakes, they worked well, but one deer was not concerned about her safety. The collision was not catastrophic to my wife or me, but at 100 pounds, the doe wasn’t so lucky. She damaged our nearly new car, rendering it inoperable, and in the process didn’t survive.  Stuck, in what to us a desolate stretch of highway between the Navajo Nation and Jicarilla Apache reservation, other motorists were few and far between.

We got to the side of the road, and my wife had enough cell signal to reach AAA. They promised to have someone out ASAP, but given our location, they warned it might take a couple of hours.  Thankfully, I had supplies in the car, water, snacks, and hand warmers (why are you laughing?).

Embarrassing to say the least.  Yes, ladies and gentlemen Playboy beats the National Council of American Indians to the important issue that now affects over 11,000 Native Americans by TWELVE YEARS.

While primarily known has a "men's magazine" Playboy also kept up with the issues of the day.  Playboy's April 2008 included a story on ousted Seminole Chief James Billie, with the article focusing on  Billies' fall from power as Chairman of the Seminole Nation and his eventual banishment by an opposing faction of the tribal council.

Haaland spoke/wrote about tribal disenrollment in the SAME DAY, thanks to CAM FOREMAN, grandson of the honorable Bob Foreman, who has been going like gangbusters on social media.  HOW hard?  Well, Fawn Sharp BLOCKED him on Twitter!  LOL

Fifth #StopDisenrollment Advocacy a SUCCESS KEEP THE MOMENTUM GOING

The 5th #stopdisenrollment visual advocacy event for 2020 was a success in many measures.

The Stop Disenrollment Facebook page reports reports over 62,000 interactions of FB, including pictures, shares, likes and comments.  It's a powerful visual and one I hope could be the last one.

This blog has seen the benefit on many visits.  The event created an opportunity to send emails to BIA and congressional staff.  I'm able to see many who check in.

Native America Calling had a show on tribal disenrollment with the estimable Dr. David Wilkins and Attorney Gabriel Galanda leading the discussion. I was able to get a call in around the 21:30 mark.

This has led to other opportunities to get the word on disenrollment and it's theft of our heritage out to many more people.   HAVE YOU shared on social media?  Using the hashtag #stopdisenrollment helps others find the information.  We must work harder in getting the stories of disenrollment out.  Otherwise, how will people know?

You will hear sovereignty often. Sovereignty, without accountability leads to nations like South Africa, which ran an apartheid nation, like some tribe's like my own, The Pechanga Band of Luiseno Indians, from Temecula.  My family has to come in a separate entrance to the homes they had since last century.


It also present the opportunity to call out the so-called Native Advocacy groups like the NCAI (National Congress of American Indians) and NARF (Native American Rights Fund) neither of which has done a DAMN THING for the over 11,000 living Native Americans who have lost all their tribal rights.

Tribal Disenrollment: Indian Termination by Indians WHO is Still Fighting For their Rights?

That's RIGHT. Indian Termination BY Indians, watched from the sidelines by BIA, NARF, NCAI, NIGC, Senate Indian Committee, The House.... 

Yes, dear friends and readers. Many Native American Tribes such as: The Pechanga Band of Luiseno Indians, The Redding Rancheria, The Picayune (Chukchansi) Rancheria,Nooksack, PALA have all DESTROYED Indian families, including the elders that have made their tribes successful. And ruined the futures of the children.  WHO STILL FIGHTS FOR THEM?

Tribes like the Cherokee and Creek have violated treaties that their vaunted elders agreed to almost two centuries ago with the Cherokee Freedmen being restored after DECADES of struggle.

We must understand that we can only fight with the weapons that are available to us: TIME, ENERGY, WILLPOWER and ALLIES. We know tribes have casino dollars to spend on politicians. We know for a fact that most of us don't have those kind of funds to fight back. And we know these fights aren't won instantly. Continued pressure will work, while a once a year event has impact for a day or two, we must show our strength and willingness to fight for our rights on a regular basis. 

Disenrollments at Chukchansi Tribe Rears It's UGLY HEAD AGAIN

After more than a decade from the first tribal disenrollments at Picayune Rancheria of Chukchansi Indians (PRCI), word is coming out that more disenrollments are on the horizon.

Facebook pages from Chukchansi people report that the tribe's  newly proposed enrollment ordinance dedicates fully one-quarter specifically to procedures for disenrollment?

The Incredibly shrinking PICAYUNE tribe seems to be more interested in self-decimation, rather than self-determination, of the Chukchansi people.  Are more mass disenrollments coming?  We put a FACE to their earliest disenrollments here

There is a document sent out for 30 day commentary to general membership by PRCI tribal council on December 17, 2018, with very probable implementation after tribal council vote, by January 16, 2019. This happens more easily when you ELIMINATE votes via disenrollment.

Anyone surprised that the next meeting of the tribe falls after the comment period?  It's almost like they planned it that way.

Word is that they've replaced their attorneys, law firm Fredericks, Peebles and Morgan. Is that a good thing?

STOP TRIBAL DISENROLLMENT: Which is the BEST WAY to FIGHT for Our Ancestors?

As we are 7 months from the last   and possibly final STOP DISENROLLMENT DAY.  The  #stopdisenrollment movement helps draw attention, but what about the other 364 days of the year?

Do we fight the unJUST action, or do we JUST HOPE something will happen?

Do we pray for JUSTICE or actively SEEK JUSTICE for our ancestors?

Do we wait and see while our elders die without seeing their rights restored, knowing we didn't do ENOUGH?

Stop Tribal Genocide Founder Emilio Reyes Forced to Sue BIA on FOIA Requests

Founder of Stop Tribal Genocide, Emilio Reyes files his first FOIA lawsuit, representing himself against the Bureau of Indian Affairs.  It seems at EVERY TURN, The Bureau of Indian Affairs drags its feet. ( see: BIA pulling OKIE DOKE )  NO WONDER they lost a Freedom of Infomation Act lawsuit to Nooksack.

The Bureau of Indian Affairs, Western Regional Office is withholding 1005 pages of responsive records on a Freedom of Information Act request. Since the agency claims exemption 6, by this complaint, Emilio is requesting the Bureau of Indian Affairs to identify each document withheld, state the statutory exemption claimed and explain how the disclosure would damage the interests protected by the claimed exemption.

Under exemption 6 the agency has the right to withhold records due to privacy concerns. However, the records requested are 77-97 years old. Under exemption 6 the agency has to do the following: 1) Request proof of death of the individuals listed on the records. 2) Provide responsive documents with redacted information 3) provide the records presuming the individuals are deceased due to the date of the records creation. The agency failed to follow any of these guidelines. Nevertheless, the acknowledgement and final letter was provided six months after the initial request.

The administrative appeal was filed to the Department of Interior (Office of the Solicitor) in Washington, DC. To this date, the appeal has not been acknowledged, accepted, or denied receipt. In accordance to 43 CFR 2.62, the basic time limit for responding to an appeal is twenty (20) business days. If the Department is unable to reach a decision on an appeal within the given time limit for response, the appropriate deciding official for FOIA appeals will notify the requestor of the statutory right to seek review in a United States District Court. The agency failed to follow these procedures.

Emilio says that even though the records are available in ancestry.com and also in the National Archives, some of the records in the repository of the Bureau of Indian Affairs, include additional notes and correspondence which are significant important to the research he's done on Mexican Indians living in the Arizona and California Indian reservations.

Pending complaints have been filed in the U.S. District Court of Southern California. Few of those complaints relate to records of the San Pasqual and Mesa Grande tribe, that the Bureau of Indian Affairs Regional Office is withholding in part or in full.

Here is the latest lawsuit to get the western region of the BIA to produce documents from a FOIA request.

The new judge, RAY DODGE, they installed to their court, after the previous judge, Susan Alexander ruled against their wished, has now been asked to RESIGN from the National American Indian Court Judges Association

MONEY QUOTE:  In sum, NAICJA does not view your Nooksack Tribal Court judicial appointment as valid. Further, while you have occupied the position of Chiefe Judge at Nooksack, proceedings do not appear to have been conducted in compliance with the federal ICRA or fundamental tenets of tribal due process at law.    
OP:  That's gonna leave a mark....and give the Department of Justice some leverage.

Vicki's family are disenfranchised but Oneida Chairman Ray Halbritter keeps them on the BIA rolls to use them for numbers when applying for grants. The disenfranchised Oneidas are denied health insurance that the Oneida Nation gives to it's members. So the disenfranchised have to apply for Medicaid or other health insurance.

#StopDisenrollment: Disenrollment Harms the NATIVE HEART Pechanga Woman Speaks

My COUSIN, wrote about how Disenrollment has affected her.  It's been a DECADE now...

With all this disenrollment going on my Rez in Pechanga I've had many of my people from the tribe and surrounding tribes come and talk and give their support from one Native heart to another. It's amazing you know to see your own people that you were sure you knew through new eyes.

I think the worst part of what I've come to realize from my disenrollment is how few Native people can really see what has been taken from me. It's a shame so many of our people are being blinded by money.But what keeps me going are those of you feel my heartache like your own without me having to say a word.

Thats what I mean when I say Native heart, I've found I can see it in the eyes. Eyes that express emotions shared by Native hearts from a shared pain that runs so deep in our souls we've come to recognize one another by the fire it feeds. I must thank everyone of you who come to me no different then you ever have, and those who come right out and bring it up, or ask how my family is, and most of all, all of you who say "FUCK UM!!" before I ever have too.

“Longest Walk 5” to make first stop at the San Pasqual Reservation, Known for Disenrollment, Abuses

A reservation well known for Disenrollment and for keeping RIGHTFUL San Pasqual Descendents from their rightful place in the tribe, will be be the FIRST STOP for THE LONGEST WALK 5

The Longest Walk 5, an event created to call attention to drug-related issues that are plaguing Indian reservations throughout the country, will be making the first stop of its nationwide trek at the San Pasqual Reservation this coming Saturday. They will stop at the tribal offices.

The LW5 will begin its lengthy journey of 3,600 miles at La Jolla Shores on the morning of February 13 and will eventually conclude its course in Washington, D.C. on July 15. Along the way, Indian leaders will be gathering information and hosting forums to better discover ways to combat the unfortunate menace that drugs have become within the Native community.

Twenty participant runners plan to cover the entire distance while many others are expected to join in along the route for shorter intervals.

A driving force behind this endeavor has been Dennis Banks and the American Indian Movement. Banks and representatives of the AIM will be there to greet the participants as they arrive at the reservation sometime between 4 and 6 p.m. Anyone interested is encouraged to welcome these road warriors who have undertaken such a daunting challenge.
All those involved are fully committed to waging a relentless war on drugs and see this event as meaningful step in that direction.
