Nooksack Police Chief Michael Ashby SUED for Assault On Nooksack Tribal Council Member

Nooksack Tribal Interim Police Chief Michael Ashby has been named in a lawsuit brought forward by current Nooksack Tribal Council member Carmen Tageant.
The Seattle law firm Galanda Broadman leads the case.
Tageant alleges that Ashby, formerly a police officer with the Ferndale Police Department, physically assaulted and battered her in Deming as she attempted to file for reelection to the council a few months ago.
“As Ms. Tageant approached the front door of the Elections Board Office, defendant Ashby saw her, with application materials in hand, and locked the front door,” court documents state.

Almost a year after being called out for "abuses of power," the Nooksack Tribe has won recognition of its leadership amid a long-running disenrollment dispute.
The Trump administration on Friday affirmed the results of a recent election in which voters filled four vacant seats on the council. The move marks the first time since 2016 that the tribe, based in Washington, has had a valid governing body.

The greatest threat to tribal sovereignty is the failure of tribes to abide by the laws they have made to govern themselves when the application of those laws do not give individuals or governing bodies the result they desire. Observing the Rule of Law only when it suits your needs or desires is actually lawlessness. It is no excuse that we live in a country whose government has been drifting into lawlessness powered by the corrupting influence of money. Tribal nations need to rise above and set and keep a higher standard.
These are dangerous times for Indian tribes with tribal sovereignty and sovereign immunity under fire, sometimes because of abuses by the tribes themselves. Employing tribal sovereign immunity to victimize and disenroll tribal members is just one of those abuses, sometimes aided by the inaction of the Federal trustee which has trust obligations to Indian tribes and their aggregate individual Indian members.
Like the rest of Indian Country, I have followed with interest how a small faction of Nooksack ‘leadership,’ and its non-Indian and Indian surrogates, have gutted the entire Nooksack Tribal Government and Tribal Courts in the process of disenrolling about 300 Nooksack Indians from the tribe, in an attempt to maintain control by what is known as the Holdover Council. After a long history of having turned its back on thousands of disenrolled Indians and flouting its trust responsibility to disenrolled Indians for decades, the United States has finally said enough is enough. It will not recognize a tribal decision to disenroll some 300 tribal members by a tribal council sitting in violation of its own constitution and laws.

More embarrassment for the Nooksack Tribe and it's unelected, null and void council. The new judge, RAY DODGE, they installed to their court, after the previous judge, Susan Alexander ruled against their wished, has now been asked to RESIGN from the National American Indian Court Judges Association

(3) the Tribal Court Judge. Recall she has "REJECTED" in-person filings.
These "REFUSED" mail-filings included response papers as to why the Clerk should be held in contempt of the Appeals Court's rulings.

Not only has the Kelly Faction violated the Tribal Court's ruling by refusing to cut Christmas support checks to the 306 families, but today they fired the Tribe's accounting staff.
On a day when the Tribe was closed, the Kelly Faction had the Tribal Police deliver all of the employees' belongings to their homes. Bob Kelly and his followers will stop at nothing! But in the end, they WILL be held accountable.

Kevin Washburn, BIA, Has Open Letter from NOOKSACK 306
Assistant Secretary Kevin Washburn was sent a letter from the Nooksack 306, the latest embarrassment to Indian Country with pending disenrollment from the Nooksack Tribe of Washinton State.
It is TIME for the BIA and the Senate Indian Affairs Committee, headed by Senator Cantwell to take a look at the violations of civil and human rights in Indian Country.

Good Afternoon,
I am writing in regards to a couple of actions that the Nooksack Tribeis taking against enrolled Tribal members.
On August 28th, 2013 a letter was sent to a couple of tribal members informing them that they are no longer being considered eligible for housing because enrollment status is not certain. The certainty of
this these tribal members as of today is that are recognized by the federal government as an enrolled tribal member.
Also, at the end of August enrolled tribal members, recognized by the federal government were denied the return to school funds. It is unclear if these funds were taken from the JOM funds, but members were asked to complete that form.
In my opinion I believe these actions are clearly in violation of the rights, if not other violations of the members needing housing and the children that were excluded from receiving funds.
In your positions of being advocates for all tribal members I respectfully ask that you investigate the legitimacy of these actions.
