Sen. Dianne Feinstein (D-California) introduced S.872, a bill to restrict the gaming rights of the Lytton Band of Pomo Indians, on Tuesday.
The bill bars the tribe from expanding the "exterior physical measurements" of the San Pablo Lytton Casino, a Class II facility in the Bay Area. The bill also requires the tribe to undergo a federal review process if it wishes to engage in Class III gaming at the site.
If this bill is not approved, the Lytton Tribe could take the existing casino that serves as their reservation and turn it into a large Nevada-style gambling complex," Feinstein said in a statement introduced on the Senate floor. "In fact, this is exactly what was proposed in the summer of 2004. I am pleased that the tribe has abandoned the plan seeking a sizable Class III casino, but without this legislation the tribe could reverse their decision at any time."
The tribe acquired the site through an act of Congress. The law backdated the acquisition in order to avoid review under Section 20 of the Indian Gaming Regulatory Act.
The tribe could conceivably satisfy an exception in Section 20 but the process could take several years. The Congressional action led to a speedy opening of the casino.
S.872 is the second Indian gaming bill that Feinstein has introduced. She is sponsoring S.771, the Tribal Gaming Eligibility Act, a bill that would limit new tribal casinos.

City of Temecula Ass-Kissing Part III: Tries to Fix Relationship with Civil Rights Violating Tribe That Practices Apartheid
The story of the City of Temecula, shaming itself by working diligently to kiss the ass of a tribal chairman (Mark Macarro) who has destroyed the lives of 25% of his tribe, including his relatives, continues unabated. The City cares not about the Apartheid practices of the tribe, as long as the income flows.
In an interview Thursday, Mayor Ron Roberts said that at the council's direction he and Councilman Chuck Washington personally delivered a letter to the Pechanga Tribal Council in hopes of re-establishing cordial ties with the sovereign tribe, which runs a casino, hotel and golf course on a reservation bordering the city.
"The Temecula City Council is committed to working diligently to rebuild a strong, cooperative working relationship with the Pechanga Tribal Council and its members," Roberts wrote in the letter dated Tuesday
The CITY, negotiated a deal that would give them millions of dollars, which became available when the tribe cut of the per capita payments via disenrollment of lifelong tribal members. That dollar value is now over $300 MILLION dollars.
It was never our intention to personally harm the Pechanga Tribe or any of its members, but rather, to protect what we thought were our legal rights until the tribal-state compact," Roberts wrote. He added the city would not appeal the lawsuit's dismissal.
Roberts, who said he has been the city's tribal liaison for 16 years, wrote that the city is willing to work with Pechanga to revise a city/tribal agreement negotiated over two years and ratified by Temecula's council in March 2010.
The 21-year agreement called for the tribe to pay Temecula $2 million annually, with the amount rising after six years to account for inflation. City officials expected Temecula could have received as much as $65 million through the agreement.
The tribe also agreed to pay $10 million or secure federal dollars in the same amount for improvements to the Interstate 15/Highway 79 South interchange, which frequently is used by casino-goers
In a comical quote from Macarro:After the ruling, Macarro said "little to no desire exists to hand over millions of dollars to a City Council that would seek to cause our tribe, our employees, our business partners, and the charitable causes which we support such harm."
In other words, DON'T try to harm us while we are free to harm our own people. Come be a business partner with a tribe that abuses elders, denied due process, ignored it's own constitution, stripped voting rights and attempted to steal water rights. A tribe that invalidated it's military veterans, wiping them clean from the tribe's website

If you believe an individual or company is not complying with California's personal income tax or corporate income and franchise tax laws, you can report that information to Franchise Tax Board (FTB). We do not offer rewards for reporting this information.
Income tax fraud is intentionally paying less tax than you owe.
Examples of income tax fraud are:
Failing to report all income received.
Claiming to be a resident of another state while residing in California.
Making false or fraudulent claims for refunds.

Ass Kissing By Temecula Works; Pechanga Gives $4 million
After the bad publicity the Pechanga Band of Luiseno Indians received by stiffing the city of Temecula of $2 million, the tribe has now decided that $4 MILLION is the number it will give the city:
The Pechanga Band of Lusenio Indians will give millions to the city of Temecula for a freeway interchange project and a full-time police officer.
The tribe said it was giving Temecula $4 million to help improve the Interstate 15/Highway 79 interchange, which is used by thousands of drivers to get to its resort and casino in the area. It is also giving $185,000 to the city for one, full-time officer to direct traffic around the resort.
Temecula and Pechanga have been at odds over how much the tribe should pay for the impact its operation has on the city's infrastructure. A federal judge recently threw out the city's lawsuit against the tribe over the issue.
Tribal Chairman Mark Macarro said in a news release the tribe had "no intention of turning our back on the communtiy," despite the lawsuit.
This donation allows the City of Temecula to turn a blind, uncaring eye on the civil rights violations that the tribe has perpetrated on some of the city's residents. An unanswered question remains: What has happened to the agreement the tribe was negotiating with the City and County?

Indian Leaders Decry "racist" comment, SILENT of Civil Rights Abuses by Tribes
Indian Country Today has an article up about Tribal leaders up in arms over a perceived "racial" comment by a Maine Commissioner, yet stand silent to civil and human rights abuses by Tribes such as: Redding, Pechanga, Picayune, Enterprise, Guidiville among others.
Indian country leaders reacted swiftly to the latest outbreak of “the language of savagery”—racist and offensive remarks made by prominent people. This time it occurred in Maine.

After Losing In Court, City of Temecula Starts Ass Kissing Campaign with Macarro/Pechanga
The city of Temecula lost it's court case to force Pechanga to pay what it promised. But that didn't keep the city from holding it's State of the City event..uh, OUTSIDE the city on Sovereign Soil of the Temecula Indian Reservation, now usurped by a branch of the tribe.
Anyone looking for signs of tension at Temecula’s 16th annual State of the City presentation on Thursday was likely disappointed.
Litigation that has churned relations between the city and the Pechanga tribe created the possibility for some awkward moments in the casino ballroom where the breakfast event has been held for years. Temecula Mayor Ron Roberts started his speech by thanking the tribe for again hosting the event, but he did not touch on the lawsuit that the city filed against the tribe in October over unpaid gaming impact funds.
Any uncertainty over the status of the relationship evaporated after Roberts’ speech ended. City officials and tribal leaders exchanged handshakes and hugs as they mixed amiably.
When questioned separately, Roberts and a tribal representative said the two sides are mending fences and an agreement is in the works to restore about $4.5 million of the withheld revenues. The revenues are seen as a key source of funds for work aimed at easing congestion at a busy freeway interchange in south Temecula.
The disclosure of a potential funding deal came as Temecula leaders are officially still pondering whether to appeal a federal court ruling that sided with tribe. Roberts said a decision to abandon the litigation has been made, but not formally announced.
"The lawsuit is over," Roberts said in an interview as the crowd thinned at the Temecula Valley Chamber of Commerce event on Thursday. "We lost, pure and simple. It’s over."
Roberts went on to say that the two sides, possibly on Monday, are expected to separately sign a letter of intent that would restore gaming impact revenues that were withheld when a previous funding agreement unraveled.
Roberts, who has served for years as the council’s liaison to the tribe, said it is important that the pair of neighboring governments repair a rift created by the lawsuit and the sharp-edged comments that followed.
"Things got off kilter for a while, but they’re back on track now," Roberts said.
Roberts failed to mention anything about Pechanga's violation of the civil and human rights of the citizens of Temecula, Pechanga members who resided in the city limits. Better to avoid doing what's right, while collecting money from an entity that practices APARTHEID in their midst. It's easier to say "WE DIDN'T KNOW" than to do what's right.

Newest Descendent of Pechanga's Original Allottee Paulina Hunter is Born
Roman Daniel Noriega, was born, April 29, 2011. He is the youngest descendent of Paulina Hunter, who the Pechanga Band of Luiseno Indians, led by the dishonorable Mark Macarro, deleted from the tribe's history.
Pechanga is well known for using the scurrilous tactic of disenrollment to change their history books. Pechanga's own hired expert, Dr. John Johnson, proved Paulina Hunter was indeed Pechanga, in fact, more so than any other tribal member. Pechanga's tribal council failed to uphold the rule of law and terminated 100 adults from the tribe. The number of disenrolled has reached nearly 180.

Tribal Leader's Forum To Hold Event Where APARTHEID is Still Practiced
With an event looking to hightlight ways to get more cooperation from the US Government, it's tragic and shameful that the Tribal Leader’s Forum chooses to hold an even at the reservation (Pechanga Reservation) that leads in human and civil rights abuses in California's Indian Country. One that practices APARTHEID on reservation lands.

Once again, tribal governments and Native communities find themselves in a volatile and unstable political environment. Although tribal governments have made significant progress in advancing and protecting sovereign rights, they face a wide array of new and outstanding issues and challenges.
We say:

In 1968, the Indian Civil Rights Act "ICRA" was originally introduced and enacted as an effort to protect individuals from the "arbitrary and capricious" actions of tribal governments and/or officials. Unfortunately, while the "ICRA" was well intended and expressly forbid tribes from taking actions that violated an individual's rights, the "ICRA" failed to include an effective enforcement mechanism which would hold tribal officials accountable for violations of its provisions.
With no oversight of the "ICRA" and not one federal dollar being spent on the enforcement of fundamental civil rights of American citizens on Indian Reservations since 1978, we must do our part to ensure Congress appoints a special impartial counsel to investigate the ongoing denial of equal protection of the law and civil liberties in Indian Country.
It starts with your signature. One does not have to be Indian, or have been the victim of rights violations to sign - anyone can. Please sign, share and get family and friends to sign.
National Petition For Justice
by People For Equal Justice In Indian Country
WHEREAS, there is no foundation for Congress’ and the Court’s assertion of a “plenary power” over Indian tribes taken as independent and sovereign governments, and such a “plenary power” neither has been nor can be acquired by conquest, treaty, or constitutional stipulation;
* Whatever may be the rule in international law, the assertion of complete and arbitrary power over non-citizens by the Government of the United States is incompatible with the Constitution of the United States, which is superior to every positive determination by the Government;
* Even if complete and arbitrary power over non-citizens were possible for the Government of the United States, such unlimited power could not be extended over citizens who, as such, are parties to the Constitution that limits the power of government;
* Therefore, insofar as the Indian Civil Rights Act applies to U. S. citizens, it exceeds the power of Congress to enact;
* The Congress of the United States can legitimately exercise no power over tribes whose members are citizens of the United States which power is not in fact a power over the citizens themselves and therefore subject to the relevant constitutional limitations;
* With respect to constitutional protections afforded against lawfully subordinate governments, the United States has no power whatever to make exceptions, for any purpose whatever;
* Not one federal dollar has been spent on the enforcement of fundamental civil rights of American citizens domiciled on reservations since the 1978 Supreme Court decision, Santa Clara Pueblo v. Martinez;
* With respect to constitutional protections afforded against lawfully subordinate governments, the United States may not apply a lesser standard of protection against itself;
* The Government of the United States has failed to provide for Indians living on reservations guarantees of those fundamental rights it is obliged to secure for all U. S. citizens living on territory controlled by the United States and under the laws of the United States;
* In abandoning by act of Congress individual U. S. citizens to the indeterminate control of tribal governments without recourse to federal courts of judicature the United States ; fails to provide the just constitutional claims for which all citizens may pray; and,
WHEREAS, strengthening tribal “self determination” has brought little or no oversight of crime, corruption or ongoing civil rights violations committed by tribal governments; and,
THEREFORE BE IT RESOLVED, that we the People for Justice in Indian Country hereby call upon the members of Congress to call for the appointment of a special impartial counsel to conduct a full investigation into the reasons Indian United States citizens are being denied equal protection of the law and access to Federal Courts when aggrieved by their tribal leaders; and,
BE IT FURTHER RESOLVED, that we the People for Justice petition for the full and complete realization of the fundamental rights of all citizens of the United States, without regard to race, ethnicity, religion, national origin, or supposed customary traditions.

OVERVIEW
In 1968, the Indian Civil Rights Act "ICRA" was originally introduced and enacted as an effort to protect individuals from the "arbitrary and capricious" actions of tribal governments and/or officials. Unfortunately, while the "ICRA" was well intended and expressly forbid tribes from taking actions that violated an individual's rights, the "ICRA" failed to include an effective enforcement mechanism which would hold tribal officials accountable for violations of its provisions.
With no oversight of the "ICRA" and not one federal dollar being spent on the enforcement of fundamental civil rights of American citizens on Indian Reservations since 1978, we must do our part to ensure Congress appoints a special impartial counsel to investigate the ongoing denial of equal protection of the law and civil liberties in Indian Country.

National Petition For Justice
by People For Equal Justice In Indian Country
WHEREAS, there is no foundation for Congress’ and the Court’s assertion of a “plenary power” over Indian tribes taken as independent and sovereign governments, and such a “plenary power” neither has been nor can be acquired by conquest, treaty, or constitutional stipulation;
* Whatever may be the rule in international law, the assertion of complete and arbitrary power over non-citizens by the Government of the United States is incompatible with the Constitution of the United States, which is superior to every positive determination by the Government;
* Even if complete and arbitrary power over non-citizens were possible for the Government of the United States, such unlimited power could not be extended over citizens who, as such, are parties to the Constitution that limits the power of government;
* Therefore, insofar as the Indian Civil Rights Act applies to U. S. citizens, it exceeds the power of Congress to enact;
* The Congress of the United States can legitimately exercise no power over tribes whose members are citizens of the United States which power is not in fact a power over the citizens themselves and therefore subject to the relevant constitutional limitations;
* With respect to constitutional protections afforded against lawfully subordinate governments, the United States has no power whatever to make exceptions, for any purpose whatever;
* Not one federal dollar has been spent on the enforcement of fundamental civil rights of American citizens domiciled on reservations since the 1978 Supreme Court decision, Santa Clara Pueblo v. Martinez;
* With respect to constitutional protections afforded against lawfully subordinate governments, the United States may not apply a lesser standard of protection against itself;
* The Government of the United States has failed to provide for Indians living on reservations guarantees of those fundamental rights it is obliged to secure for all U. S. citizens living on territory controlled by the United States and under the laws of the United States;
* In abandoning by act of Congress individual U. S. citizens to the indeterminate control of tribal governments without recourse to federal courts of judicature the United States ; fails to provide the just constitutional claims for which all citizens may pray; and,
WHEREAS, strengthening tribal “self determination” has brought little or no oversight of crime, corruption or ongoing civil rights violations committed by tribal governments; and,
THEREFORE BE IT RESOLVED, that we the People for Justice in Indian Country hereby call upon the members of Congress to call for the appointment of a special impartial counsel to conduct a full investigation into the reasons Indian United States citizens are being denied equal protection of the law and access to Federal Courts when aggrieved by their tribal leaders; and,
BE IT FURTHER RESOLVED, that we the People for Justice petition for the full and complete realization of the fundamental rights of all citizens of the United States, without regard to race, ethnicity, religion, national origin, or supposed customary traditions.

Why the City of Temecula LOSES to Pechanga. UPDATED
Now we know why the City of Temecula's ill-fated suit against Pechanga failed. It's because they don't have any brains at the city.
The City of Temecula is holding their "STATE of the CITY" event at the Pechanga Resort and Casino! Now, let's see:
A tribe that signs a contract with you to give the city $2 Million a year then reneges on it and then you have an event there? The city should halt ANY business with the tribe and not let the Casino prosper from the city coffers, while Pechanga has a stranglehold on money they promised.
UPDATE: In following the link on the state of the city, the city is ALSO holding a golf ticket sale at JOURNEY, the golf course on the Pechanga Reservation, that was built on a site that Chairman Macarro promised would not be built upon, you know, the one that has our ancestors buried on it?
Another question: WHY wouldn't the city support a venue that is actually....you know, IN THE CITY? You know, city council, one that pays TAXES to the city?

Political Interlude: President Obama Releases Birth Certificate
Our friends at HOTAIR have the report that President Obama has released his Birth Certificate after 3 years of speculation begun by the Hillary Clinton campaign and carried forward by birthers who can't understand the evidence that already existed. This conspiracy theory should have died three years ago. Now, maybe we can focus on all the ways Obama is failing as President.
Let's forget about the birther issue and concentrate on the fact that thus far, his administration does not care about the civil rights violations in this country. His Secretary of the Interior, Ken Salazar is silent on the issue and Larry Echohawk has terminated MORE Indians. Contributions are more important than violations, eh, Mr. President?

Pechanga Chairman Speaks Against Temecula Quarry Project: If He's Opposed, Should we be FOR?
The tribal chairman of the Pechanga Band of Luiseño Indians pleaded with Riverside County Planning commissioners tonight to block the proposed Liberty Quarry, which he said would destroy one of the tribes most sacred sites.
Mark Macarro (He who lies to Congress)said the quarry, which would be just east of Pechanga's land, would hollow out a mountain that was central to his tribe' creation story. The mountain is analogous to Christians' Church of the Holy Sepulchre or the Dome of the Rock for Muslims, he said. OP: What a blowhard. You DO know he doesn't live on the reservation, don't you?

Remember, this is a man who thinks the people of the tribe are worthless and terminated 25% of the tribe, including descendents from original allottees of the reservation land. Macarro and the tribal council were looking to purchase this land, NOT for the value of the mountain to the tribe, but because it would give the tribe "environmental credits" for building on other areas of the reservation. Macarro did not present it to the general membership as the "sacred mountain".
Macarro is a charter member of the HALL OF SHAME and you have to ask yourself if he was putting on a show.
