A reminder of a post from 2007 where Pechanga remaining members (remainers?) were upset that we were speaking out in public about the horrid actions of the CPP haters. We culled the story from Paulina Hunters blog on My Space. In essence, the remainers are upset about being called out, but NOT upset about violations of civil rights, human rights, Pechanga Constitution, Child Molesters.......

We've received a lot of comments from families of CPP members that we have spoken out against. They are not the least embarrassed about what their relatives have done to the tribe.

Shawn, Thanks for writing. We HAVE accepted the truth. The TRUTH is that we were screwed by the Concerned Pechanga People, which includes Butch Murphy, who has NO Pechanga blood. Now, the TRUTH, as proved by Pechanga's own hired expert, (The Hunters DID NOT HIRE HIM, Pechanga did) is that Paulina Hunter was Pechanga. The TRUTH is, that Pechanga Disenrollment committee has depositions taken in the Luiseno language from 1915 that prove that Paulina Hunter is Pechanga. The TRUTH is that Paulina Hunter has census reports from 1895 that says she's from Pechanga. That's 112 years ago. YOUR people, is OUR PEOPLE, Shawn. Educate yourself a little more. Ask yourself why a moratorium is legal? Because of the will of the people? Then why wouldn't that same will of the people, that voted overwhelmingly to halt all disenrollments not followed by the tribal council? You need to accept the truth Shawn, and know that if you don't help to right the Pechanga ship, it will go down. Would you fight for your rights to be Pechanga? Delila, the problem is that WE DID prove that we were from Pechanga, and in fact, the Pechanga Enrollment Committee PROVED we were from Pechanga, by hiring their own expert, who SAID we were from Pechanga. They chose to believe a child molester instead, and one who stood up in the General Meetings and complained the we weren't voting the way they wanted, and a guy who's two sister's are on the enrollment committee. Gloria W, who came to the reservation 100 years after Paulina was there, and of course, one who doesn't even want her brother in the tribe.
I understand that you don't care if we got disenrolled, you benefit by more people getting kicked out.

The Concerned Pechanga People have been active in getting rid of two large families from Pechanga. But, according to this flyer from 1992, they absolutely DID NOT like some of the people that they subsequently conspired with to remove the Manuela Miranda and Hunter Clans. Here's the flyer:

The CPP accuse Jennie Miranda (former spokeperson for Pechanga and mother of thief Larry Miranda, soon to be indicted) of "being unfair to people" and telling "lies" and wanting to bulldoze sensitive sites and burial grounds. AMAZING that after all this, the CPP would work with Jennie to use her mother AND Frances Miranda to eliminate people.

Does this sound like someone who cares about the tribe, or themselves? CPP, how could you turn on your own people, with people like this?

And Enrollment Committee HOW could you trust people like this? And we all know, Frances hasn't got any nicer with age.

Pechanga's Splinter Group: Anti-Pechanga Constitution and Bylaws

The Splinter Group Part 2.

The Pechanga Band became concerned about the question of enrollment in the early 1970’s. Many years of debate and discussion led to the presentation of a proposed final enrollment application and proposed procedures.

Between 1979 and 1981, using the approved process, approximately 456 members were enrolled and given enrollment numbers. During the screening of applications, the Enrollment Committee returned approximately 45 that were incomplete and requested further information from the applicants. There were also about 20 enrollment applications that did not meet the standards set by the Band.

Those standards, found at Article II of the Band’s approved Constitution and Bylaws include the following:

Membership is an enrolled member documented in the Band's Official Enrollment Book of 1979.
Qualifications for membership of the Temecula Band of Luiseno Mission Indians are:
A. Applicant must show proof of Lineal Descent from original Pechanga Temecula people.
B. Adopted people, family or Band, and non-indians cannot be enrolled. Exception: People who were accepted in the Indian way prior to 1928 will be accepted.
C. If you have ever been enrolled or recognized in any other reservation you cannot enroll in Pechanga.

The 20 applications that did not meet the standards involved the descendants of adopted members. People who would not be eligible for membership based on the Constitutional requirement. They included members of the Splinter Group.
The applicants were sent letters stating that their application for enrollment “has not met with the standards approved by the Band” The same letter advised the applicants that there is a provision for appeals to the Band. None of the individuals so notified ever appealed the decision of the Enrollment Committee.

In fact, as far as could be determined at the time, only one member of the Splinter Group, its leader BM, applied for membership in the Band. BM was sent the form letter advising him that he would have to appear before the Band on the issue of enrollment inasmuch as he was the descendant of an adopted member. BM never requested a hearing before the Band.
None of the individuals that were on the Splinter Group’s “council” were enrolled members of the Band.

Instead, you have a small group of perhaps 20 who simply refused to comply with the will of the band as a whole and who refused to apply for membership. Could it be that they knew then, as many know now, that they would not and should not be granted membership?

Instead of appealing to the tribe, those who would not be considered members based on the Band’s membership standards found another way to gain membership. However, this way did not include complying with the Band’s membership requirements as listed in the Constitution.

Riverside Supervisor Suggests CHANGE in Soboba Leadership

Supervisor Jeff Stone is wrong in his approach here. Mr. Supervisor, you have no business recommending a change in leadership at the reservation. That is tribal business. YOU SHOULD, however, recommend to your constituents that they stay AWAY from the Casino and reservations until it is deemed safe and until you feel that the tribal leadership is taking the necessary steps to protect San Jacinto and Riverside county citizens.

ADDITIONALLY, you should be recommending that all Riverside County residents stay away from Pechanga, for violating its members basic human rights and civil rights and for failing to follow its OWN CONSTITUTION. While you shouldn't call for a leadership change there either, you SHOULD recommend that NO citizen of Riverside County patronize a local business that would treat American citizens the way the sovereign nation of Pechanga did to their people. Would you have recommended buying Krugeraands while South Africa was practicing apartheid? No, I believe you wouldn't.

Please recommend that Pechanga be avoided for the similar reason, denying some of its people civil rights, voting rights, and citizenship that was rightfully theirs.

Express your MORAL outrage, Mr. Supervisor, by NOT supporting Pechanga with your business, county's business and the patronage of your constituents. Pechanga has the right to violate their own tribal constitutions, strip their citizens of their heritage and rightful place in the tribe, and tell them to go to hell. YOU, me and our friends and customers have the right to AVOID Pechanga because of their unjust, immoral actions. Make sure the county does NO more county business at Pechanga. Might I suggest, Turtle Creek, or maybe the wineries? Do you think Pechanga, like South Africa will respond to disinvestment?

Supervisor's Criticism

The Soboba tribe is also finding itself at odds with 3rd District Riverside County Supervisor Jeff Stone, who on Thursday called for a change of tribal leadership and suggested the violence could be a repeated if that does not take place. Stone, whose district includes the reservation, told about 150 people who had gathered in San Jacinto that violence connected with the reservation is nothing new. Stone suggested that part of the problem is tribal leadership, which he said needs to be more sophisticated in the way it does its job.

CA Stonewall Democrats, SEIU say NO on 94-97

Add the California Stonewall Demcrats AND the Service Employees Internation Union (54,000 strong) in saying:

NO to Pechanga
NO to expanded gaming
NO to Propositions 94-97

Uncle Woody also says NO on expanded gaming:

Ask a public educator how much money he or she sees from California's Lotto. Go ahead... I'll wait.Not very much, you say? Then you can understand why Uncle Woody is less than impressed with the argument that Indian Gaming pumps millions of dollars into California's economy. When you factor in all the costs associated with gambling and its effects on the average family, that revenue pales by comparison.

We have proof that the tribe did break tribal, state, and federal civil rights laws in the way our disenrollment occurred.  We would not have been disenrolled if the tribe would have not broken their own constitution and by laws, yet because of sovereignty there is no avenue that is unbiased and fair that we were able to use in determining the fairness of our claim. I always believed that as a US citizen I had rights, yet this is not the case.

The issue of sovereignty is important for all tribes, but what about the tribes like Pechanga who abuse and misuse the trust that is given to that government. All of the tribes are being hurt by just a few corrupt tribes that care not for the people or the old ways. We were once proud to be associated with the Pechanga tribe and it is a same to see how far from the path they have strayed. Is it money , power, or an outside influence that has somehow taken the spirit of Pechanga and it's once peaceful. It is a shame to know that now none Indian whites Who's ancestor was adopted in to the tribe back in 1928 are on the tribal council and they are the one’s who have done this to the people. The rest of the tribe is afraid to speak up for fear of the same thing happening to them. Instead of blaming us go after and investigate further what is being said. Its easy to say what you do because you have not had to live through this kind of injustice and you only see one side of the story, but CA would not have to worry about protecting sovereignty if they the tribes had not broken the law and trust of the people both Indian and White.  Guero Nunez aka White Buffalo

There are several factors that were involved in the enrollment committees decision to disenfranchise us, yet this is not what the official disenrollment report read, the real reasons are our voting block was one of the largest and knowing this the then current council was afraid of losing power in the upcoming elections, and then there was the per cap disbursement, It is obvious in the timing of these occurrences. First the tribe waited until the last of our ancestors, who had first hand knowledge of our rightful claim, died and then we were disenrolled just before elections. During the processes of disenrolling us we were not allowed legal representation nor were we allowed transcript's of the proceedings. As interested and affected members of this tribe we were told that the rules do not apply as they would for other US citizens because of the sovereign status the tribe held and that constitutional law was not applicable. There are many other thing that were involved during the proceedings that were illegal, yet this forum is not the place for that. 1846 - Up to 125 Luisenos were killed in a December attack in retaliation for the killings of 11 Pauma persons who had stolen horses.

2004 - Over 300 Pechanga men, women and children from Temecula Band of Luiseno Indians were eliminated by a corrupt enrollment committee.

Pechanga Cheats its Members: WHAT WOULD YOU DO?
Pechanga (meaning the tribal council and disenrollment committee) has CHEATED its members, by disenrolling them from the tribe. They have wronged over 500 people, when you include spouses and children who cannot claim membership.
Since 1995, almost 12 years, they have been paying per capita to each member of Pechanga. Here is the breakdown as they give for loan authorizations for the first years:
1995: $1,075 1996: $3,360 1997: $20,204 1998: $39,853

Now, bear in mind that by 1998, this is MORE money than many of the tribe has made in a year, EVER. You'd think that people would be HAPPY to be making an extra $3,000 a month.
1999: $44,071 2000: $47,744 2001: 63,800 2002: $91,000

Well now, in 8 short years, tribal members are making $7,500 per month, got health care approved and guess what? CPP started getting JEALOUS of what San Manuel was making (significantly more, due to smaller membership) so they started looking at how they could get more money.

Was setting a positive example of tribal unity and good public relations to build business and relationships the way?

Was getting rid of some members so you could control power and get their per capita the way to go?

But what about the tricked-out, turbocharged pickup in the sedan’s rearview mirror, closing in quickly? That would be Indian gambling, which pulled down almost $23 billion in gross revenues in 2005, according to statistics compiled by Los Angeles economist Alan Meister.
Once dismissed for running second-rate rural bingo halls inside big tents, gambling tribes in the past decade have dramatically narrowed the gap on commercial casino operators.



But gambling also disrupts tribes, says Gover, who was assistant secretary for Indian affairs in the U.S. Department of the Interior from 1997 to 2001.
Disputes about who belongs to a tribe, let alone who should lead it, now get attention.
The size of a tribe affects the size of payouts, if a tribe is distributing some of its gambling profits to individual members. About one-third of gambling tribes do so, according to 2001 data from the National Indian Gaming Commission, a federal regulatory agency.
“Before, who cared what your share of nothing is?” Gover says. “I think the pace of these disenrollments has picked up.”
Disenrollment is the review process by which a tribe decides that a person who has claimed membership does not qualify.

Yes, those who have been disenrolled at Pechanga Reservation in Temecula, CA were members when there was NOTHING but the land. The concerned Pechanga People were the greedy ones, and many aren't even Pechanga. Why should California support a nation like that...
