San Pasqual Tribe Claimed Protesters "PROPENSITY FOR VIOLENCE" To Get FREE SECURITY for Protest

Yesterday I wrote of the heavy police presence at the San Pasqual Reservation.  It seems that not only does Allen Lawson lie about being San Pasqual, his leadership lied about the protesters.

We heard from officers on scene that they staffed based on a call they got about the protest, which claimed that the protesters had a "propensity for violence".   That was the reason for nearly 20 law enforcement units staged at Valley View Middle School.

This was a waste of police manpower.   There were NO threats of violence.  In fact, one of the leader's Huumaay Quisquis was so forceful in his speech to the 90 plus protesters, to do this in a "peaceful manner" that there was no reason to get arrested to accomplish their goal.

All San Diego County residence should be asking for the San Pasqual Tribe to compensate county taxpayers for wasting their money.

Senator John Barrasso to Lead Senate Indian Affairs Committee: Letter Included

The Wyoming Republican says he's honored to serve in the post and he looks forward to working with others to pass legislation that helps improve the lives of people across Indian country.

Congratulations on your election to Chairman of the Senate Committee on Indian Affairs.

A recent report by the Government Accountability Office (“GAO”) referenced the fact that internal tribal disputes “seem to be occurring more and more frequently”.

Such disputes have resulted in the disenrollment, banishment, denial of membership, stripping of voting rights, and/or denial of health/medical benefits of thousands of Indians.

In response to the growing number of these types of disputes, the GAO felt it was necessary and appropriate that nominees to the Secretary of Interior be asked how they would address such issues. I feel the same should be asked of the new chairman of the Indian Affairs committee.   Since most of the civil and human rights abuses have occurred under Democratic leadership , I believe it is also important to know how you have or would work with individual Indians in trying to resolve or prevent such disputes.

Therefore, I would like to know where you stand and what you believe your role as Chairman would be regarding (1) internal tribal disputes and (2) the protection and preservation of individual Indians’ basic rights in internal disputes. In addition, do you believe that tribal sovereignty and the protection of basic individual rights are mutually exclusive of each other?

For a wet, soggy and rainy three hours, over 90 men, women and children stood in protest against the violations of rights of the San Pasqual people.    Some were there from PALA and Pechanga, standing in solidarity for those that have been disenrolled.

Today was election day, and we'll have word on the results later.  Here is a video of the protest, we'll have more later:

I'm just arriving at the Valley View casino and I see 15 San Diego County Sheriff cars massed at the middle school.

Maybe they didn't get the message that this was a peaceful protest? Hopefully they won't outnumber the protesters

UPDATE:  Topped the 90 mark, in the rain.  We even walked UPHILL BOTH WAYS as the tribal rangers opened up the back gate so members could sneak out....

Remember When: PLAYBOY MAGAZINE recognized Disenrollments at Wrong

How Bad is the issue when Playboy recognizes tribal disenrollements are for CASH, but our CA Senators Barbara Boxer and Dianne Feinstein do NOT?

The April 2008 edition of Playboy magazine features and article about deposed and banished Seminole leader James Billie. The article, entitled "The Man Who would be Chief", chronicles the Seminole leaders rise to power and his efforts to bring tax-free cigarettes and high stakes bingo to the Seminole tribe. Eventually, the Seminole nation was flush with cash as slot machines and Class III gaming replace the bingo games. 

The article then focuses on James Billies' fall from power as Chairman of the Seminole Nation and his eventual banishment by an opposing faction of the tribal council. 

As a side bar, page 56 highlights the disenrollments at Pechanga: 

"The Pechanga band of the Luiseno tribe operate California's most profitable casino: its resort in Temecula grosses as much as $1 billion a year.

But don't tell this to John Gomez, Jr. or the 135 members of his extended family who were kicked out of the Pechangas after tribal leaders ruled one of his deceased elders wasn't a true tribal member. The elder in question left the traditional village after her marriage; therefore, according to the tribal leadership, her descendants aren't really Pechanga.

The fact that Gomez is descended from Chief Pablo Apis doesn't seem to matter. When the Gomez expulsion was finalized in 2004, each of the 1,000 adult Pechanga members got about $15,000 a month from casino profits; after a more recent round of disenrollment booted another 10 percent from the tribe, the figure rose to $40,000 a month.

That's a big payout, but it's no wonder. As the Economist reports, gamblers will lose more money this year in Indian casinos than in Atlantic City, Las Vegas, Reno, and Macau combined."

San Pasqual Is the Location for Peaceful Protest Against Civil/Human Rights Violations

The event will draw attention to the growing number of human and civil rights violations occurring in Indian Country. The violations, which include the denial of such basic rights as due process and equal protection, have contributed to the growing number of disenrollments, banishments, and denial of membership that have swept through Indian Country. 

This protest is sponsored by descendants of The San Pasqual tribe, which has denied membership to a family due to a miscalculation of blood quantum, which protesters say they refuse to correct.  Injustices like this are not unusual since the advent of tribal gaming.

In California alone, nearly thousands Indian people have been stripped of their tribal citizenship since the approval and expansion of Indian Gaming in 2000. Additionally, thousands more have been denied their birthright as tribes close their roles in an attempt to limit the number of those who benefit from Indian Gaming.

PALA bound Tour Bus Collision Hospitalizes 13

A preliminary investigation indicated one big rig struck a second, which in turn veered toward the center divider and collided with the tour bus, according to Al Perez of the California Highway Patrol.

The bus was either in the carpool or No. 1 lane, Perez said. “It’s very fortunate for everyone involved that no one got seriously hurt,” said Perez, who was on scene. The bus was labeled “Bus Limo Express” and, in much smaller letters, “operated by Da Zhen,” aerial video showed.

A representative of the Da Zhen Travel Agency in Monterey Park confirmed the bus was headed from Monterey Park to Pala Casino in San Diego County.

Pala tribe is well known for disenrolling members of their tribe to boost per capita payments and control votes...

Senator Barbara BOXER WILL RETIRE! Hallelujah, After A Decade of Failure to Protect Native Americans UPDATE

Word breaking this morning that California Senator Barbara Boxer, who has done NOTHING to protect the civil and human rights of Native Americans harmed by their own tribes, will retire.

UPDATE:  ISSA fires a volley:  There’s been a vacancy for two decades,” Issa said outside a men’s room near the House floor. “The fact that she’s not running doesn’t change the fact it’s always been a vacant office.”


We met with Boxer's Native American legislative analyst last year, on a bill where Pechanga was attempting to redefine what an allottee was, and steal our water rights, a bill written by the high paid lobbyist wife of Pechanga Chairman Mark Macarro.    At least her guy had the decency to be EMBARRASSED when called out on her sponsorship of the bill.

Is it too much to hope that we can get someone in office who will ACTUALLY care about what tribes are doing? Can we find someone to put an end to corruption?

 GOODBYE Senator Boxer, sorry you were so ineffective and unresponsive to the needs of your constituents.

Chukchansi Accused of NOT PAYING MEMBERS After VIOLENT TAKEOVER

From Fresno News:

Chukchansi Casino remains closed Wednesday night-- as it been since early October-- following a violent takeover attempt.

Tribal members arrested in that scuffle remain in jail, too.

And, according to court documents filed in December, one group claims tribal moneys are paying for the criminal defense attorneys representing those who were arrested.

The filing by the Morris Reid faction is calling on the courts to order full accounting of all tribal monies since mid-October.

Documents claim that the Tex McDonald faction is using tribal money it stashed away, for his defense attorney, and the attorney for Vernon king.

It also urges the court to hold a third faction, led by Reggie Lewis and Nancy Ayala, to be held in contempt.

A federal judge allowed this faction to maintain control of the casino's books to pay mandatory gaming commission fees and make equal payments to every tribal member on the enrollment list, dating back to December of 2010.

But, documents claim not everyone received their monthly checks, for nearly 400 dollars.

The filing lists 77 members who had been on the list, but never received their money.To remedy this, Reid is asking the court to appoint a receiver, to oversee the casino's finances.

AND

Tax season fallout is coming from the Chukchansi casino closure. Gamblers say they're getting the runaround over critical documents. Three months into the casino's closure, some gamblers have gotten paid out. But they could still be losers at tax time.

The sign off Highway 41 reads "temporarily closed", but the doors at Chukchansi casino haven't opened for months and the machines have gone dark. Gamblers were briefly able to cash in chips, but as the time approaches to reckon with the IRS, a new worry is growing.

"With the casino being closed, I'm just concerned we're not going to get our win/lose statement that I need to have for tax purposes," said Kathy Madrid of Coarsegold.

Gamblers pay taxes on winnings and can write off some losses. Chukchansi always gave out W-2G forms for winners, but losses piled up unaccounted -- usually until the casino sent statements people can use when they file.

"I have the forms from the jackpots that we did win at the casino, but I don't really save anything else any more," Madrid said.

For now, nobody seems to know if the process can go smoothly with the casino in flux. The Tex McDonald faction, which does not occupy the casino, told me they don't have access to the numbers.

"They have the documents over there," said Donna Featherstone, the sitting chair of the McDonald faction. "(They) illegally took over. They're rogue. They were never appointed and they were never voted in."

San Manuel Tribe's JAMES RAMOS Elected CHAIRMAN of San Bernardino County Board of Supervisors

The first meeting of the San Bernardino County Board of Supervisors for 2015 began Tuesday with the election of a new chairman and vice chairman, supervisors James Ramos and Robert Lovingood, respectively.

“I am honored my colleagues have chosen me to lead the board over the next two years,” said Ramos who represents the Third District. “It is truly humbling to serve as the first Native American supervisor and now chairman of the Board of Supervisors.”

Ramos is a Serrano Indian and member of the San Manuel Band of Mission Indians. He is the former chairman of the tribe, and served on the San Bernardino Community College District’s Board of Trustees prior to being elected supervisor.

Ramos said he was looking forward to working with his colleagues on the board and moving the county forward and continuing to establishing more policies and procedures to keep the county on that trajectory and holding public officials accountable.

We are a group of NATIVES in need of assistance to retain legal council. The legal council will represent the group of former Tyme Maidu natives, which were injustly disenrolled and financially penalized by the corrupt Tribal Council of the Tyme Maidu Tribe. We plan to file suits against the tribe for blatant violations of tribal members civil rights. 

This case will serve as a starting point for all other natives that have been persecuted by the CORRUPTION strangling our tribes. We hope to set a precedent with this case, which will provide legal justification for many suits from other natives in the future.  Please support the unheard voices of all NATIVES, and show that we as a community can stand up to the bully Tribal Governments. A win for us in the court system will provide the building block for legislation changes to protect all tribal member's civil rights, and not leave us at the mercy of the greedy Tribal Governments.
