First, I will state my bias up front, I am opposed to the disenrollements. I also disagree with the comments made by Professor Goldberg, and I like to think that she was taken out of context. However, since we can only react to the quotation provided, namely her characterization of the concerns of those who have been disenrolled as "overblown"; I find myself wishing that she would have keep her comments restricted to the legal issues at hand. To diminish the identity, financial, and legal crisis which arises as a result of being disenrolled from a tribe, in my opinion mischaracterizes the true loss. This loss tears apart families, disrupts lifelong friendships, and creates personal identity issues. Furthermore, I disagree with her notion that tribal sovereignty is diminished as a result of a tribe explaining themselves to the non-Indian world. On the other hand, tribal sovereignty is reaffirmed through educated and reasonable explanations of their actions.
