Questions for AS Indian Affairs' Kevin Washburn on Abuse in Indian Country and the BIA's Involvement

Thousands of Native Americans have been harmed by our OWN TRIBES, with the BIA's tacit approval.  Yet, we can't get Assistant Secretary of Indian Affairs to go on record against tribes who do this.  WHY?  We have some questions here, if you have more, the COMMENTS are open.


1. What is the BIA's and the U.S. governments responsibility to protect the individual Indian from harm by their own tribes?  

2. Is there a requirement that a tribal member be Native American?  If not, does a Non Indian tribal member have more Native rights than a true Native American disenrolled member in the eyes of the BIA?

3. When are you going to show leadership for the BIA, and step in to support bringing ALL the disenrolled and unrecognized indian people home--where we belong!

4. Since the BIA must approve all tribal constitutions, why does the BIA not act when tribes do not follow their constitutions, such as not giving due process, which happens when fair hearings aren't allowed?

5. What responsibility do you have to correct the mistakes or wrongdoing by your predecessors or their staffs, Such as the San Pasqual Applicant descendant matter?

6. WHY do we need the Bureau of Indian Affairs, if your department is NOT upholding their fiduciary responsibility to Native Americans

I can answer question number 5 for you. The reason the BIA is dragging their feet is because the BIA will change the blood of the Martinez Descendants. It will be determined to be LESS blood than anticipated by undisputable facts. One being that an ancestor was predetermined to be 4/4 San Pasqual but in fact is 4/4 Inaja. This fact is backed up by numerous documents and will actually disenroll members of that family rather than enroll members of that family. This is where the BIA is having trouble or else they would have decided on this issue already. This is not new information. Alexandra McIntosh is decieving these individuals because she is an Attorney and this is what attorneys do. Don't belive the facts? Call them at 760-737-7628. They might be hesitant to help bit if you say you're a direct descendant the can surely lead you in the right direction.

Question: Why does the BIA deny due process to appellants of diesenrollments? The BIA does not provide hearings before an independent tribunal and instead conducts appeal procedures within the agency.

Question: Why does the BIA resort to sovereign immunity to protect tribal leaders from tribal members? Tribal members are just as entitled to immunity as leaders are.

Question: In a recent Answering Brief the BIA's attorneys claimed that the matter was a case of a dispute between a tribe and its members. A tribe consists of its members. How can there be a dispute between a tribe and its members? This fallacious reasoning belies the BIA policy of treating tribal leaders as the tribe and tribal members as a group distinct from the tribe.

I called as a concerned Jose Juan Descendant. Martinez's are not related to anyone from Inaja. That's a fact. She told me to go look in the archives. I know where Im from and I ain't no Inaja.

1. How is it that the BIA can go through more than a hundred years of determining tribal membership, allottee eligibility and blood quantum requirements then completely walk away from defending the very people you deemed to be allottees/tribal members.

2. Allotments in California were done under the authority of the Dawes Act and therefore the approved Allottees enjoy the status of being listed on a Dawes Roll. The Dawes Act specifically says that once a Dawes Roll is approved NO ONE CAN CHANGE IT as per the order of the Congress of the United States. So when did you become more powerful than congress? When did tribes become more powerful than congress?

Well, let's see is August 19, 2015 at 10:19 AM Dave Toler or Angela McNeil. Whichever, it is no surprise you continue to write lies. Neither of your families are San Pasqual. The Jose Juan descendants, those enrolled and those yet to be enrolled, have more San Pasqual blood, not less. The lawyer has exposed ALL of your families. The entire world knows the truth, now.

Sounds like the BIA isn't going to give in to the Jose Juan Martinez descendants. On Reztalk they talk about taking over the reservation with force. Hopefully no one gets hurt. Doing illegal actions to get your way never works. Id get a new lawyer. She's giving the Martinez Family bad legal advice. Original Pechanga gives so much credibility to a drug addict(Hummay Quisquis) and a family law Lawyer who's never been in a federal court(Alexandra Mcintosh) and a 20 year old expertise on Indian disenrollments(Emilio Reyes). Pure Comedy. Why don't you look into the reality why the Trasks are on San Pasqual instead of listening to a bunch of morons.
