CUPA Newsletter: Why Pala Band Of Mission Indians SHOULD NOT BE Federally Recognized

The Juaneno and Gabrieleno tribes, both NOT FEDERALLY recongnized should be raising a RUCKUS over how this group was able to obtain federal recognition.     Take a look at the newsletter King Freeman of Pala, who has been denied his participation rights in meetings, as well as having his voting rights stripped, has sent out:

In the first Cupa Newsletter it was said that it is the Old Pala Indians who are the Pala Band of Luiseno Mission Indians of the Pala Reservation.  This is the tribe that is listed in the Federal Register.

All of the lands of Old Pala were allotted to the Luiseno Indians and therefore the Pala Band of Luiseno Mission Indians are a landless tribe.

The Pala Band of Luiseno Mission Indians are not organized and do not have any governing documents. Below are entries of Federally recognized tribes in the Federal Register over the past 3 years.

If PBMI was Federally recognized it would appear between Pala Band of Luiseno and the Pascua Yaqui Tribe.

The Pala Band of Mission Indians is not listed in the Federal Register therefore it is not a federally recognized Tribe even though the PBMI Constitution fraudulently states it is a federally recognized tribe.  No wonder Robert is so anxious to become the chairman of the Pala Luiseno.

So why is the BIA calling Robert Smith the chairman of the Luiseno Tribe. Realize that Robert Smith and the BIA just gave the Luiseno people 345 acres of land that was purchased with your money.

This is from the first page in a letter to Robert Smith dated March 3, 2014 from the BIA Director, Pacific Regional Office, Amy Dutschke stating that she has approved taking the land in trust for the Pala Luiseno.

The land referred to herein is situated in the State of California, County of San Diego, and is described as follows: ***

Old Pala was established by Executive Order in 1875 at the same time the Agua Caliente Reservation was established in Warner Springs. They were both established in 1875 at two different locations. This means that the Pala Luiseno and the Agua Caliente CupeƱo were recognized as separate federally recognized tribes.

The lands purchased for the Warner Ranch Evictees at Pala were purchased for the Agua Caliente Tribe, San Felipe Village, Puerta La Cruz Village and landless Indians not having rights to other lands.

It is these groups that form the Association known as the Pala Band of Mission Indians. The Pala Band of Mission Indians is not a Tribe but an organized group that agreed to govern their lands in an equitable manner.  When Robert Smith pushed his Constitution the BIA approved it stating that the Pala Band of Mission Indians is a Tribe. This was done illegally.

Then, the BIA transferred all the powers of PBMI to Robert Smith. Membership in PBMI was never a tribal membership but a Band membership established to protect your individual rights of the assets of the Pala Reservation.

It is time to fix it and take our rights to these lands back.

Reyes "King" Freeman's was denied his rights because he was a nuisance and we voted for it. He made tribal matters public and got what he deserved. Obviously he didn't learn because he still doing it. The letters are a joke your face was priceless when the chairman went to the fundraiser in front of the store the other day haha.

He uses his hallmark "ha, ha" and that's his tell. Robert was overheard bragging that he was f-ing with the disenrollees by sending out anonymous hate letters and using a handle PalaRez. I didnt believe it until I saw this posted with his ha,ha line. What a schmuck.

We Juaneno's have too many families fighting and the can't get on the same page. One factor was the Belardes family and their negligents and they think they are the most powerful. hopefully someday we are recognized but the Belardes screwed our reserve so bad that we may never be federally recognized.

King Freeman had his rights to voting and participation in government stripped from him by a rigged vote of the General Council. There were non-members allowed to vote, and the vote count was not correct. This action was a response to an effort to suspend the Pala EC in order to conduct a financial audit. The Pala EC distributed a financial report that was a duplicate of the prior year's results and there were other violations that caused the General Council to call an Emergency Meeting to discuss the allegations and take appropriate action. This meeting was not conducted in a public forum, and King Freeman was only one of over seventy members who attended.

These false accusations and insinuations are never substantiated with evidence. It appears to be a personal vendetta that Palarez has against King Freeman. Then the accusations are directed toward King's niece and the Agua Caliente Tribe, and what does that have to do with this Newsletter? Just rants and raves from an individual with an axe to grind who refuses to address the matter at hand.

Here the Cupa Newsletter addresses the misidentification of the Pala Band of Missions Indians with the Pala Band of Luiseno Mission Indians. This is a very important issue! The Pala Band of Mission Indians does not appear on the Federal Register List of Indian Entities Recognized and Eligble for Services. That means that PBMI is not federally recognized. PBMI operates tribal gaming under the name of the Pala Band of Luiseno Mission Indians. The BIA has committed a horrendous error that is shocking in its magnitude. All the functions of the Band that require federal recognition are being conducted under the name of the Pala Luisenos.

Now from the horrendous to the outright inane. What difference does it make if Robert Smith's wife is Old Pala? Does that somehow make it legitimate to lie to the National Indian Gaming Commission and the California Gambling Control Commission about the name of the Band?

For Amy Dutschke to put land into trust for the Pala Luisenos is also a heinous error. The Pala Luisenos are not organized, they have no governing document, no elected representatives, and no land. Unless you count these 345 acres that were purchased by PBMI. So the Band buys land and then puts it into trust for a phony chairman, and a tribe that has no land rights. Then you get a knucklehead like Palarez who tries to defend this action by blaming King Freeman and his niece.

Any reasonable person can see that King is only trying to get out the truth. Robert Smith and the truth have a love hate relationship. He Hates to tell it, and he Loves to lie about it. Palarez can keep on defending the liars, but Robert Smith should hire someone who actually can tell a decent lie. This Palarez is good for a laugh but is making the chairman look worse that usual if that is possible.

No one should be afraid of Robert Smith. He will never do anything to you in court no matter what you say. Of course it is almost impossible to say something about the wrongdoings of Robert Smith and not have it be true. Without the umbrella of sovereignty Robert Smith is the biggest pansy around. A real wimp. He won't go to court against anyone because that is an automatic waiver of sovereign immunity and once he crosses that line then all his hidden assets will be discovered. Did I say his assets? I mean your assets that he has hidden away for himself.

There is always the possibility that the FBI will indict Robert Smith, but I am not holding my breath. The US Government appears to have a special interest in propping up the corrupt Chairman. The BIA has gone to bat for him numerous times, and has actively participated in the misidentification of the Pala Band of Mission Indians with the Pala Luisenos. They are trying to make it appear as though the Cupeno never existed, and have completely breached the trust duty obligation to protect the lands, assets, and resources of the Warner's Ranch Evictees.

Our ancestors wanted to leave their descendants a heritage and legacy on the Pala Reservation and the Pala EC has stolen it all. They did this by conning the Band into adopting a Constitution that gave them the power to enact ordinances and to create an Enrollment Ordinance that gave them authority to disenroll. The part about disenrollment came from the BIA. It was one of the recommendations for revision to the Original Constitution that came from the So-Cal Agency Superintendent. We now know that the Original Pala Constitution included a provision in the membership section for Kupa and Pala tribal affiliation. The BIA recommended that Kupa be omitted, and then made sure it was eliminated by retyping the Constitution into its final draft.

The Pala EC never discussed the recommendations with the General Council. No one knew what was in the revised Constitution. There was no vote by the General Council to accept or reject any of the recommendations. On the one hand there was direct interference by the BIA with the wishes of the General Council when the reference to Kupa was eliminated. On the other there was complete secrecy by the Pala EC as to the changes that allowed them to usurp the power of the General Council.

They used this power to create and enact an Enrollment Ordinance that gives them total power over the membership. They also used this power to create a Gaming Ordinance that gives them total control over Casino revenue. Now they use the threat of disenrollment to remove ay opposition to their agenda to strip the Band of its wealth.

The EC is the power in Pala, the General Council is Smith's and Nieto's puppets, and the only ones trying to tell the truth are King Freeman and the disenrollees. Now all Pala members have to worry if the path that Smith has taken to steal all the money will cause them to lose everything. If the Pala Band is not federally recognized will the Casino get closed down? Will the BIA continue to allow PBMI to say it is the Pala Luisenos? If so will Robert Smith use this error to transfer more wealth and assets to the Luisenos? If he does that it really means it all goes to him since the Luisenos aren't organized.

It is a disgusting mess.

Why are you saying nobody knew, thst this "power grab" was not translucent or transparent to the General Council? Let me tell you something I know about this whole disgusting mess, during the 1990s, before tribal gaming came to Pala and when tribal meeting were held at the Old Tribal Hal, most members never attended tribal meetings. Power grabs take time, they don't happen overnight. Back then I would hear, from my elders, the following: the EC was not conducting meetings properly, not a lot of tribal members are going to meetings, only certain people are at meetings, tribal members don't care about the meeting, people only show up at meetings when they want something, people don't respect each other at meetings and let each other discuss issues, meeting gs used to last all night now their done in 30 minutes, prople are hollering at each other and nothing gets discussed, people are pushing things through without discussion, mrmbers are voting for things without thinking about the future, people are voting on things,without knowing what they are voting on, out of the 800 members who live on the rez only 50 or less go to the meetings and actively are involved, nobody cares about what the elders think, and so on and so forth. The things that stood out the most were the following: Robert is slowly changing the Articles of Association, the EC is slowly changing it's power, the EC is gaining to much power and the people voting for it don't know what they are doing to the future, the General Council is giving their power away to the EC. I can tell you this, Robert Smith has been to most of those meetings, he has seen what has hsppened, who goes, and I would assume can predict how things are going to Plat out based on past performance. I believe it's to late for change, the process for change was planted in the early 90s, now you are seeing it's effects. Why all of a sudden, why now, why are you trying to stop something thst was started in thd,1990s, is it because you lost a right, a privilege that you never used, maybe if more of the people who were disenrollment actually went to and we're concerned about tribal government prior to tribal gaming like they are now, the wheels of this "change" could have been recognized and stopped. Maybe if more people were involved in their trib as l government prior to tribal gsming, things could have been different. Today, their is more involvement, but tribal politics has transformed from its humble beginnings and is now a completely different animal. I am not blaming the disenrollment for what happened to them, I am just highlighting how that process was made easier. Today's politics need to be countered with more than just newsletters and once a month meetings. You need to counter decades of change th as t has culminated into what has happened the past 5 years. Counter political change by creating a political counter movement, exposing misinformation is one strp, but you need to utilize other methods (campaign for the EC slots, figure out the voting block, spread knowledge to the off reservation members, link the change that has affected a few to a process that has involved and can affect everybody.) The only way this will stop is either through revolutionary change through democratic peace or violence. Hopefully, the tribal community can agree on the future of itself, and the future of how that trajectory will platvout, but more need to be involved, and more needs to be done.

I agree that a counter movement is necessary. It is happening right now. The Chairman told the General Council about it at the last meeting. First things first though. The path to success must be paved with evidence and then we must gain support from the Feds. Without that we will not move forward.

The path you describe, of working within the framework of tribal government has little chance of success. The elections are rigged, the Pala EC has all the power, and if the people really did understadd the implications of the plot to usurp power and let it happen then perhaps it was what they wanted. I don't know. Right now the people coming out to support positive change are the disenrollees. If change is going to come, then they are the ones who will spearhead it.

It certainly won't come from the EC and their supporters. And all those families that wanted the Britten's out and would rather have a corrupt chairman who robs them blind and threatens them and their families can have him.

Ok, Robert Smith is now calling himself chairman of thd PALA BAND OFLUISENO MISSION INDIANS although that tribe has never held a election to name him as such, they have no governing documents and are unorganized. I think the plan goes like this, Robert has already sent a request to Washington D.C. to change the name of the PALA BAND OF LUISENO MISSION INDIANS to the PALA BAND OF MISSION INDIANS, now this simple name change gives The PALA BAND IF MISSION INDIANS the federal recognition of the PALA BAND OF LUISENO MISSION INDIANS. If he pulls this off its only because it cost MILLIONS, money that should be on your per-capita check. Another problem may be devastating to this plan.The PALA BAND OF MISSION INDIANS now have the federal recognition of not only another tribe, but of another reservation, a reservation that is separate from the reservation land purchased for the Warners Ranch Evictee's, a reservation that has NO CASINO. The pala Casino is built on the land established for the Warners Ranch evictee's. If the pala band of mission indians assumes the identy and federal recognition of OLD PALA, a.completely different and separate reservation does that mean you give up your rights to revenue generated from a casino that is built off your new adopted reservation land? The PALA BAND OF MISSION INDIANS members who still possess more than 10 brain cells better take serious notice to this.THE PALA CASINO IS ON THE RESERVATION LAND OF THE WARNDRS RANCH EVICTEE'S, old pala has no casino on their reservation. Forget our Ancestors, forget how the reservation was created, forget why is was Federally recogbized as Temecula band of Luiseno mission Indians. Thats a sad fact.

The question that Pala members should be asking now is why the BIA decided that the shared land of the Warner's Ranch Evictees was open to the Pala Luisenos? This happened when the Pala Band of Mission Indians was formed and all members were given equal right and access to the Pala Reservation. Did out ancestors really want it that way, or were they forced into an association and equal sharing by the BIA?

I believe it was the BIA who required the groups of Pala to form an association. This was done in order to share revenue from the Sand and Gravel operation on the reservation. But the Sand and Gravel Company was working on the Warner's Ranch Evictees land. None of it could be done on the allotted land of Old Pala.

Now it is the same with the Casino. The BIA made sure the Luisenos were included by affirming federal recognition of the Pala Band of Mission Indians under the name of the Pala Band of Luiseno Mission Indians. So now there is gaming approval from the NIGC that was issued under the sovereign rights of the Pala Luisenos on the land of the Warner's Ranch Evictees.

It could have worked for the benefit of all and been a great boon for all the groups of the reservation, but the greedy and corrupt Chairman decided to steal, then steal a lot, then steal a lot more. Now there is a group that has been excluded through a conspiracy whose participants are Robert Smith, Amy Dutschke, Robert Eben, Frances Muncy, Sarah Dutschke, Kevin Washburn, Theresa Nieto, and the rest of the Pala EC members.

It is a disgusting mess.

If Pechanga had honored the Bands constitution and followed custom and tradition this blog would not be here. If Pechanga had respected the votes and voice of the Band we ALL would be enrolled and our Ancestors would have ALL been respected. The band spoke clearly, just like when Murphy was adopted by the band. Then factions did not like the bands voice and went against custom and tradition broke the bands law and dishonored Ancestors and our ways according to custom and tradition. Here we are today, hopefully the Band can justify or reverses the choice made by the factions who dishonor ALL.

It doesn't matter if Robert Smith calls himself the Chairman of the Pala Luisenos. What matters is that it appears on federal documents and the federal register. It is incumbent upon the individual to correct errors of identification. If the individual lets it slide, then they are complicit in a fraud.

King says all this yet when he was vice chairman he signed plenty of documents that said PBMI is excersing its Inherent rights as a sovereign, federally recognized tribe. He just keeps trying one thing either his dementia is kicking in or he's just that stupid and hateful.

Robert is abusing sovereignty. He is using it as a shield for all his corrupt dealings. The federal government will catch on to this tactic that a lot of corrupt leaders are using and amend the sovereignty laws. It's only a matter of time.

Where is Cupa newsletter No. 3? It's posted on the door of the store. More BS lies and envy from King, as usual seems like he post these letters the day after tribal meetings, because he's mad he can't attend well he's got himself to thank. Surprised OP has posted it yet King must of forgot to email it to him. Heard the Pala Store's books are being looked into. King shouldn't have anything to worry with the upcoming audit. I have a feeling he runs his store just like he ran the tribe, and that's not too well.
