Pala Disenrollments Discovered by LA TIMES; Is Robert Smith, Chairman of Pala Lying?

The Los Angeles Times has finally caught wind of what is happening in California's Indian Gaming Country. THe link to the full story is at the end of this excerpt, we recommend that you SHARE the story on Facebook and join the comments.

The shameful disenrollments at Pala are in the news.

But now, renewed doubts about Britten's lineage are at the root of a divisive "blood quantum" dispute roiling the 1,000-member Pala Band of Mission Indians, formed by the fusion of the Cupeño and Luiseño bands.

At issue is whether Britten was a full-blooded Indian. OP: That issue was settled by the BIA decades ago.

The governing board of the Pala Band in the last year has "disenrolled" some 162 descendants of Britten, cutting them off from their monthly share of the tribe's profit from casino, hotel and other business ventures, about $7,500 a month, in addition to health insurance and other benefits.

The Pala dispute echoes those at other Indian tribes in California and elsewhere, where money has complicated disputes over identity, nationhood and personality conflicts, according to David Wilkins, professor of American Indian studies at the University of Minnesota and a member of the Lumbee tribe in North Carolina.

"Somewhere, as tribes have tried to reconstruct their sense of nationhood, particularly in tribes with casino money, they hit upon disenrollment as a way to settle disputes over personality issues and money," Wilkins said.

The American Indian Movement estimates that upward of 3,000 tribal members from two dozen tribes in California and other states have been "disenrolled" in the last 15 years. "Tribes are being destroyed by it," Wilkins said.

Firms now offer DNA testing to prove Indian ancestry, while "disenrollment clubs" offer succor to those no longer welcome in their tribes. Angry websites collect accusations of betrayal.

Robert Smith, Pala's strong-willed chairman, is not moved by the appeals of those who have been disenrolled, nor by the dire assertions of Wilkins, nor by recommendations from Bureau of Indian Affairs officials to reverse the disenrollment decisions.

Smith said evidence shows Britten's father was a white man, not an Indian, and thus Britten and her progeny were not full-blooded Indian.

"This is not about money, this is about what's right," Smith said during an interview at the casino's food court, to the plink-plink of nearby slot machines. "I've heard all the arguments about Margarita Britten. All the old people knew: She was only half-Indian." OP: All the current people know, Robert Smith is a tyrant.

Robert Smith quoted Macarro to atee. It's not about money....LOL. That's exactly what it's about, and political power within the tribe. Mark said it best when interviewed about the disenrollment. When Pechanga didn't have anything, no one wanted to be Pechanga, but when it looked like they would have a Casino, everyone came out. Problem is Marcarro didn't move to the reservation until it looked like money was coming. Also, the people who he responded about had been on the reservation since WW2. If they ever investigated the families that kicked out the Hunter's they'd find that, unlike the Hunters, they are not Pechanga Indian at all.

It is not just all about the money it is also about keeping poltical power as Smith just eliminated a voting block.

This is a perfect example of becoming what you were taught to hate so much living on the Rez.
Never think or act like the White man, this includes big business and the governments philosophy.
Never turn on your own people and remember where you came from.
Well since people like Mark and his brother came in, that has changed to “This is all Business”.
Remember, you do become what you Hate.
“Divide and Conquer” “History always Repeats itself”.

Ever wonder why all the Pechanga Indians speak Mexican? Well, it's probably because they are Mexican and NOT Pechanga. Here's an example of one of them. Quoted word for word.
"I went on Ancestry.com and found out that my great great grandparents were born in Mexico!!! Now it all makes sense!!! Their names were Tirsa and Evaristo Ayala, parents of my great grandmother, Dominga Ayala, who was registered as a Pechanga mission Indian." So how can they be Pechanga you might ask?

for ALL nations...for ALL chukchansi people said...

know your history...

back in the day, there WERE no artificial "country" boundaries...many tribes now recognized in the united states had--and have-- sacred sites across what would now be the united states/mexico border, as well as lands extending across what is now the border...relations and bands of "united states" tribes STILL exist across borders...in fact, many of them are still fighting for the use and preservation of those very sites....

STOP THE HATE!!! INDIGENOUS IN THIS CONTINENT HAS NO BORDERS!!!

It’s not about the money? When the Hunters were disenrolled from Pechanga Mark Macarro and his brother John bought multimillion dollar homes that month. Its public record. I wonder what Robert Smith is buying with his sudden increase of money. I heard that when Pechanga disenrolled not all the per capita money went back to the tribe. A percentage of the disenrolled per capita was skimmed off for Mark and his crew. Is Robert Smith doing the same?

Fact is BIA has done extensive research and in 1989 made a final determination that she was in fact 4/4 pala blood. The general council voted to Accept that decision and Smith himself signed letters saying she was 4/4. Again last month the bia said we again have researched it and she is 4/4 pala blood. what gives Smith the right to go against a 1989 FINAL decision by the Bia he is a corrupt leader and the tribe should call a meeting and have him removed. These people should be reenrolled because they are who they say they are and it has been proven at the highest level. I don't know how Smith and his rogue executive committee can live with themselves and one day they will have to answer to the man above to their corruption

I don't know anything about this family's history other than I have seen the name on some of the census records.

However, 'For All Nations' is correct, local people had a presence on both sides of the current borders.

Do you realize that the Luiseno dialect , the language of the Pechanga, and some other local dialects have a few words that are rooted in the Aztec language?

Not a lot of them but some so that shows a historical relationship between the indigenous people in what is now Mexico and those who now live in Southern California.

Anonymous said...

Besides this but California used to be part of Mexico, so if you were a California citizen. I guess maybe that made you a Mexican Citizen (seems so to myself). That is until Mexico ceded California in 1848.

'aamokat said...

Add on to my last post, but just because there is some historical connection between the indeginous tribes on both sides of the current border, doesn't make someone Pechanga but, as I said, I really don't know the history of the family of the people that were mentioned.

However, I don't see anything positive about the racist rants that turn up here from time to time.

I'm just saying it's unusual that so many Pechanga Indians speak Spanish. I really think that the people with ancestors that were given allotments should all be enrolled, and the ones without allotments should not be. It's also funny to see red-heads and blond Pechanga Indians as well. I not saying they don't have Pechanga Blood though. Maybe 1/132?

The post states: "Smith said evidence shows Britten's father was a white man, not an Indian, and thus Britten and her progeny were not full-blooded Indian." I have been the attorney for the original Pala Disenrollees since June '11. Never has Smith put up one shred of evidence or even bothered to write up his position and let the Regional Director review it for its legitimacy. Now, he puts it in a news article. Poor showing. If he feels so empowered to destroy the identities of 162 of his "own", then what will he do next? Attacking a proud woman of 4/4 Indian blood and heritage then saying he has evidence in a newspaper article when he never put it on the table in the beginning is the worst thing a tribal leader can do to his own People and the Spirit of Margarita Brittain.

Genotypes and Phenotypes:

Genetic and what 'shows'(phenotypes)

For ex: Juan was 100 Pechanga and Dorothy was white.

Evelyn was 50 Pechanga and husband 100 white

Evelyn had 3 children. 25 Pechanga and unknown white and ? or white.

Two of three of Evelyn's children had children who are redheads or phenotypically 'show' redheads....

It doesn't mean only redheads will 'show.' Any combination of any of Juan and Dorothy's genetic expressions as well as all their ancestors before them can be seen by us now as "strange."

Now, of course, many redheads and blonds, etc. may simply not be Pechanga Indians at all.

My sibling and I each 'show' different phenotypical expressions from each other.

DNA testing is amazing...we can 'look' like a racial group but be genetically something else all together.

My mother hid my identify until I was about 12 yrs old. I had no idea she used an alias for me until I saw my birth certificate at 19.

If I had known my true identity and who my father really was, I would not have felt so disconnected from my sibling. While we had the same biological 50% Pechanga Indian father, we 'showed' vastly different phenotypes.

My sibling was fair and light-haired. I, on the other hand, was darker and our body types were very different.

It was not until I DNA tested that I knew how our Pechanga Indian and European mix genetics 'showed' in each of us.

As we continue to mix our phenotypes will continue to show amazing expressions.

For ex: Juan was 100 Pechanga and Dorothy was white.
It is my understanding Juan Macarro only was an allottee because he was married to a Pechanga Indian? A Hunter ancestor? Is that the case? Anyone know? So he was on the late 1800's Pechanga Census only because he LIVED on the Pechanga Reservation? Him being registered is pretty much at the hypocritical, but more accurately an atrocity. I'm sure the Enrollment committee will want to hire California Indian Geneologist, John Johnson. Maybe that is what the CPP has hanging over his head?

Anonymous said...

You speak of Enrique who was half brother of polinario.Enriques' mother was Guavish.

Macarro are document-loaded. BIA Certificates of Indian Blood degrees;etc

Juan's children CIBD 50% Pechanga.

Do you insist the anthropologist trumps the feds?

Go to ancestry.com plug in Macarro on California Indian Census 1800s and pages on Juan will spill forth.

It is no secret that documents exist. Enrollment has copies. Gomez surely saw copies. No surprises.

Juan's grandchildren CIBD 25%Pechanga

Billy Wasson aka Bill Todd 25%

CIBD Pechanga redhead
His daughters 1/8degree redheads

Carole Wasson 25% CIBD Pechanga
bore a son 1/8 degree redhead.

Victor Rocha 1/8 degree.

Re: Johnson is not infalliable. For enrollment criteria to be met, it is documents that are certified.

On the contrary,if Mark is indeed the biological son of Leslie, he is certified CIBD.

There are very few with Pechanga CIBD and perhaps this is why mendacious is kept as sham for counterfeits.

Every tribe has their shams to 'present.'

Btw Macarro had primitive Indian name ...look at back of Indian census schedules, you will see earlier names of families.

By all means, contact anthropologist and have EVERYONE submit Federal documents...dna results would be helpful too!
Surely anthropologist stated walla was area and coyote de ano indicated a mixed breed.
Agents used terms like walla and coyote to describe Indians.

People in for many surprises. I have! take care

In the San Luis Rey Mission records of Juan Macarro's second marriage to Isabel Tapia in the 1890s, a relative of Paulina Hunter, it says that he had been a resident of Pechanga for sixteen years but that he was from Pauma, another local Luiseno tribe.

So if the Macarros are trying to claim their tribal membership through Juan but they are descendants of his first wife, then they are not Pechanga.

However, don't they claim to be the descendants of Paulnario Macarro, Juan and Isabel's son?

Ironic that back in the day, if Juan was a Luiseno, even if he was from Pauma, who was living at Pechanga when the reservation was created and he had lived there for years when he married one of the people, the people wouldn't have objected to him being considered one of their own and it is only since gaming that they make a big deal out of it.

But fair is fair as the enrollment committee claimed, falsely though, that we the Hunters are from the San Luis Rey Tribe, so if the Macarros really are from the Pauma tribe, then they shouldn't now be tribal members.

'aamokat said...

By the way, the San Luis Rey reference for the Hunter family was because her grandson John Miller said he was San Luis Rey in a 1928 application for enrollment as a California Indian but anthropologist Dr. Johnson said that was the same as someone today saying he or she is Luiseno and that a lot of other people from other Pechanga families still in the tribe also had family members stating in 1928 applications they are San Luis Rey.

Ironic that one of the reservation census records from the 1890s is titled, "Temecula Reservation--San Luis Rey Tribe."

So for the enrollment committee to kick us out because a family member said he was San Luis Rey is absurd!

Only know what BIA documentation shows.

Does anthropologist have documents from feds? Other than Census?

Apis is well known and heavily documented...

All this is sad; very tragic.

Apis left a legacy; one that is well documented.

I have no mob, no gang ....only me. No false arguments...I only have Federal documents like you do.

I do not fault anyone for trying to present their ancestors in a good light. God knows Mark, etal is leaving a despicable legacy for his descendants to try to defend.

Again, this is a tragedy..nobody wins. Everyone loses.

We could all take DNA tests together, at the same time to compare results.LOL

I am not hostile to your cause..in fact, through these trying times, I have become quite fond of several of you.

We are all doing our best to do the best we can for our descendants.

Anonymous said...

the list is a fraud blah blah blah right ? thats what they will say jajajajaaja

Anonymous said...

Fletcher made up documents in the riverside office...

Anonymous said...

The enrollment you speak of was rife with fraud and was loaded with counterfeits who rigged the so-'enrollment' and 'constitution' to accomodate; cloak the counterfeits' imposture.

Counterfeits had total control of Pechanga and the tide turned. Waaaa

Termination was illegal. When the tribe was reorganized, those recognized by feds were morally and ethically to be placed on 'new' roll.

Not talking list. Talking gathering in person and having an independent dna tester collect samples at the same place, same time, etc.
those claiming kinship with Macarro.Aunty and uncle are terms of endearment to show respect for another among peoples. It does not necessarily mean a direct lineal blood descent.

It's very sad to observe humans twist and turn to conspire to 'prove' fiction when fact is fact.

As I say... I am alone. I do not speak with my sibling regarding Pechanga at all; nor do I speak with my 2 children or my 5 grandchildren and now I have a grt grandchild regarding Pechanga.

I do not want to contaminate my descendants with what is happening.

I am just documenting. Observing and reporting. I am not interested in conjuring up a false legacy.

Why the tenacity? My mother betrayed her two children by hiding our identities and tagging us with aliases without our knowledge.

My sibling and I had 2 very different life experiences living with our mother. I do not know what my sibling knew regarding our father.

I still am working through my feelings regarding my mother's betrayal and the events that resulted as a consequence of that betrayal.

What of Juan? I do not pretend to know who Juan was or was not. There were more than one Juan Macarro and Macarro and his clan had a more primitive name.

Was he? was he not? Those 'in the know' are not sharing any documents. Oy vey!

God bless us all...and...good luck!

Anonymous said...

p.s. Fletcher was not the only person creating forged documents. He, Virgil Townsend, and others conspired to create a faux 'tribe.'

She has collected documents that describe how 'tribes' were formed.

Oh well, all tribal governments will be corrupt to some extent, some more than others, it's the price one pays trying to live under them, the white man gave them the rule book to hide behind, the key word is sovereignty, an individual indian's nemesis to civil rights.

Not saying your cause isn't without merit, but the lady is still crazy, she might have your facts right, but majority of her bullshit is way out there, just say'n.

Mark is in deeper than he ever thought he would have to go. The lies and misinformation he and his wife’s consulting firm continue to spread will be his downfall. Lying to cover up your desperate attempt to change history will backfire on you Mark like nothing you ever expected. Your brother John, has used the tribes sovereignty to shield you and corruption as you falsify the tribes history and allow corruption to flow through and you paint your lies in a corner. The Pechanga legal department assisted the corruption with written documents that will continue to be presented to lawmakers as proof that Pechanga does not follow custom and tradition, and legally has used government positions to try and erase family lines who do not agree with the corrupt factions of the Pechanga Indian reservation. One of the biggest mistakes you have made is allowing the use of the Legal department to send out a memo saying that the tribes General membership cannot determine membership issues, when you know how your friend sitting next to you on the council had to go to the General membership and ask to be adopted according to custom and tradition. Allowing corrupt information to be used to follow through on illegal actions of elected officials is serious and you yourself know that written documents will erase any thing you say to the contrary. Jennie will be facing embezzlement charges, will you be next?

Anonymous said...

Macarro was sucked into the black vortex from the start. The frontal cortex of his pea brain was undeveloped...and...his reasoning faculties have led to his downward spiral.

Macarro had an older predecessor of corruption who guided him into the abyss of corruption. Billy Wasson(Macarro) aka Bill Todd should have known better; however, he was dealing with demons of his own.

The action results in a moral and ethical dilemma for John Macarro...John Macarro never stood a chance of fulfilling his promise of achieving a moral and ethical gift of service.

Now, both he and his wife, Kristina Cornell Aquino Macarro are sullied by their involvement.

That led to despoiling of Kaiini Lupenui who was 'adopted' for purposes of fraud?

To further complicate matters, Lupenui aka Macarro married Luker aka joker...they have a spawn.

Oy vey! counterfeits spawn now a counterfeit as well.

What are the ramifications of attorneys who participate in corruption?

Add to the mix the devil's disciple, Holly Cook. Another Oy vey!

Damages of Macarro's follies grew exponentially with each criminal act.

One might presume Macarro's greed, avarice, ego and false pride are rapidly pushing him to the the edge of an abyss.

Macarro has not acted alone. He followed the earliest wolves' examples who set the agenda leading to what is now a full blown fiasco.

Sovereign governments? Who is mendacious Goldberg trying to fool with her 'government' crap? Carole Goldberg has been using her UCLA cloak of academia; sowing and cultivating her personal brand of injustice she supports; is good for her corrupt tribal business! For Goldberg, Public Law 280 is bad for business! Goldberg? sovereignty? Internal Matter? all suit Goldberg's objectives of imposing her special brand of injustice against American Indians to serve her own best interests and those of her syndicate.

Goldberg, like her corrupt compadres are making the devil blush with shame.

Her use of UCLA as a cloak of academia to ensure her clients'criminal acts against innocent victims are never exposed and punished.

If Goldberg were an American Indian suffering humiliating injustice at the hands of ruthless tribal predators, she would be singing a different tune...and...that tune would NOT be removing states and federal protection for American Indians!

The federal law mandated civil and criminal jurisdiction over tribes in six states and authorized several others to assume jurisdiction if they chose. Washington did so in 1963, assuming state involvement in such matters as juvenile delinquency, truancy, mental illness and adoption proceedings and enabling state courts to hear cases involving Indians.

Alright we now know how you feel about Goldberg. As your words are convincing on an emotional level it is now important to make your statements credible by backing up what you say with facts of her wrongdoings. Show me in her own words what she has said or written that troublesome to you or harmful to Native Americans. If you do this people will listen more intently and perhaps look at her differently. As it looks right now you are just some person who appears to be on a verbal tirade who is unimportant because there is no substance behind the accusations. I am not saying that I disagree, but there is no proof there that I can agree with or check to see if what you say is true. Also it helps your credibility to post with your name or other recognizable screen name. As you may have read my post in the past you know me as White Buffalo but my real name is Guero Nunez

Anonymous said...

I respect u Nunez..so I will tell you, I have been on a long dangerous journey without any support and protection from anyone.

I have been more than generous in divulging information.

I will not be goaded.

There have been witnesses where Goldberg has been confronted in front of witnesses...and....cowards have quietly kept their balls safely in their pockets.

What I say, is what I say. Believe it or not.

Frankly I do not care if anyone agrees or disagrees.

I can tell you, I am a very quiet and trusting human. When I reveal anything it is because I believe I have a moral obligation to tell others whose human and civil rights are affected by the ethos she and her syndicate are practicing.

Now,if cowards with those balls in pockets, speak up, you would know more.

Goldberg is one very important cell of a syndicate. The reason she is so important is that she is using the cloak of UCLA as her 'academia' platform and 'Indian Law' to implement her objectives.

There is another critical aspect to her ability to deceive; that is using the sham of an Indian accomplice.

I don't blame you for your skepticism; I still am in shock.

Usually, it is smokey who is burly LOL and you speak differently.

Many voices are speaking. The voices can be confusing; however, each it its own way, is very important...even the hostile ones, the misleading ones...

We are all so different and through these many long years, we are acting as the Pechanga tribe digitially; to have our voices heard.
