Pechanga's Culture of Corruption II: Pechanga Lawyer Macarro Accused of Threatening Tactics



It the recent handout from duly elected PDC official David Miranda, he accused Pechanga Band of Luiseno Indians' legal counsel, John Macarro, little brother (literally) of the current chairman, Mark Macarro of threatening him. They are trying to say that David may have threatened tribal sovereignty and abused his authority by ASKING FOR PERMISSION from the PDC President and the CFO. Uh, wouldn't THEY be responsible, it that's if fact what happened and NOT David Miranda?

What could be the reasons for this? Retaliation against the Anthony Miranda family for putting forth a petition to HALT ALL DISENROLLMENTS in 2005? One that was constitutionally APPROVED by the Pechanga tribes and overturned by the Mark Macarro led tribal council? (with votes from Andrew Masiel Jr, Russell "Butch" Murphy and Mark Calac) OR more likely an attempt to manipulate the upcoming elections? Remember, TWO large families AND their votes were ELIMINATED from the tribe via disenrollment (see Pechanga's Indian Removal Acts.

I immediately called James Kawahara to find out if we could get the paperwork back; however, James told me that he ad already submitted th paperwork to the plaintiff as trial exhibits.


OP: Culture of corruption reminder. John Macarro had this to say about land that brother Mark PROMISED Congress would be used because it was culturally significant.

Here's a quote by John Macarro, shorter brother of Mark, from the Press Enterprise: In response, Pechanga's General Counsel John Macarro, wrote, "Once the land is placed in trust, a tribe has complete zoning and planning authority over it and can change land uses just as a county or city can change or update its general plan or zoning designations."

Reportedly Mark Macarro used the tribal rangers to keep the Tavizons off of their own property and he claimed it for himself.

Sounds like an abuse of power to me.

"It is the duty of all elected officials to uphold the rights of individual tribal members without malice or predjudice."

So does this part of the Band's constitution not apply concerning land coveted by Macarro?

The Tavizon's, direct descendants of Paulina Hunter, were tribal members when reportedly Macarro did his land grab so why weren't their rights upheld?

So are some of the Macarros thieves as well as liars?

Non-members: Get a life. Drop your negativity and anti-social outlook. Try seeing the good side of things. You have been booted for lack of membership qualifications. Your removal from the tribal roll corrected an error in it. Bashing others and slinging mud will never reverse your due disenrollment. You have been sent on your way; now, go away.

If the Anonymous is addressing the Manuela Miranda and Paulina Hunter descendents when he says, GET A LIFE.

This IS part of our life you nitwit. We are trying to rectify a wrong that was done. Lack of membership qualifications is a ridiculous argument that you are making. There was NO error.

Bashing others, including the Macarro brothers, the crime family and the Murphy's is just one step.

It may NEVER reverse the disenrollment, but it WILL cost YOU money, as it already has. We won't go away because we have ties to the land, something that many don't have.

You didn't quit when you wanted to destroy people, why should we quit trying to reverse a wrong? You can't defend what was done to our families, and what is done to those in the unconstitutional moratorium as RIGHT, or JUST. Therefore, you are fighting to justify something you did WRONG.

So why won't the tribe correct an error in the membership rolls and enroll people who it was found to have submitted their applications before the deadline for the moratorium but who have been stuck in the moratorium for over twelve years?

Yes, correct an error in the membership rolls the other way if in fact disenrolling us was in a correction (something that was never proved) and take in moratorium people who have dated applications that were in before the deadline.

But I doubt you would support letting them in as all you seem to side with is keeping people out of the tribe.

Clearly, "anonymous" does not know what he or she is talking about! If they did, they would know that the Hunters have more proof of being Pechanga than virtually every family that is still in the tribe. I know because I have researched every family there! So if I were anonymous, I would get the facts straight before I open my mouth and continue to spread that "Propaganda Excuse" of "correcting the tribal roll." What a load of crap that is!!! It is very easy to hide behind a pack of lies and tell other people to get a life. I certainly didn't see any members asking about the truth before we got disenrolled or volunteering their own paperwork. Everyone jusshut up and pretended they didn't know what was going on or bought the hype that the Macarros and Masiels were dishing out. The problem is that payback is a bitch, so good luck to you when it happens to you! One day the truth will come out an then we will see who needs to get a life!

Yes, as O.P. points out, we have ties to the land because we have a land patent as Temecula Indians given to us by the United States government in the 1890's that even the bogus ruling of the enrollment committee in our Record of Decision informing us we were disenrolled does not dispute.

Also, as I have pointed out several times before, even Hunter family members who have had loved ones die and whose probate for their share of the Hunter land allotment was after our disenrollment have official Dept. of Interior probate documents that name their deceased family members as Mission Indians (Pechanga Band).

So clearly The United States government still considers us Pechanaga Indians even if the tribe officially (at least for now)does not.

So anonymous critic, if we truly don't belong, than why doesn't the Pechanga tribe finish the job and take away our land, which would send us on our way once and for all?

They wouldn't dare to try it because then the federal government would step in and the tribe would have to really prove that we aren't Pechanga and that what they did to us when we were disenrolled was right and that taking away our land is also in fact the right thing to do.

THE BOTTOM LINE IS YOU WOULD LOSE IF THE DECK WASN'T STACKED IN YOUR FAVOR.

SO NO, LIKE IT OR NOT, WE ARE NEVER GOING AWAY!

Anybody ever notice that each time our anonymous "friend" pops in here he gets less and less specific after we shoot down his tired old argments again and again?

My cousin said yesterday, we should live like Rosa Parks. After a Bing search on Rosa Parks, I agree. Hunters should live like Rosa Parks, thank goodness she never gave up.

To any tribal members who read this blog. We are not attacking Pechanga as a whole. It may seem that way by some posts, but that is exactly what it is, a post. The cancer in the tribe, the CPP have caused this blog to spring up. We are not going anywhere, and will never stop telling our story to anyone who will listen. We do have the truth, and the proof. Our rights have been violated, and you would fight this if it occured to you.

I hope you do win one day and I hope you get all the money that is owed to you since you have been kicked out....and the tribal members that are skirting taxes by saying that they live on the reservation when they dont....please turn them in to the tax authorities....California is tax hungry right now and they reward people for turning in tax cheats....only you ex-tribal members really know which ones are cheating....THANK YOU and good luck...i personally wont step into Pechanga until you get some satisfaction.

Anticipating our anonymous tribal member critic's response, he will likely say that just because we have a land allotment doesn't mean we are Pechanga.

That Indians from other local tribes who were living at Pechanga also got allotments.

But in going through the allotment records any exceptions to being a Pechanga Indian were noted in the margin of the official allotment list.

For example, Jose Antonio Sal, who received alottment #68, is listed in the allotment records as being a Pala Indian.

By contrast, my ancestor Paulina Hunter, recipient of alottment #62 is listed as Head of Family which is the same designation as a lot of other Pechanga tribal members who got alottments.

SO WE ARE READY FOR YOUR LIKELY BRILLANT COMEBACK AND WE HAVE ALREADY ANSWERED ONE OF YOUR LIKELY RESPONSES.

Gilbert Tavizon had started his preparing his home on the Pechanga lot before his death September 2001 when he passed away unexpectedly. After his death, his widow and two member children wanted to finish their home.

So AFTER probate and AFTER obtaining new approval documentation from the Tribe to allow them to finish their home, the Tavizon family invested their life savings to finish their home. Yes, it is true that Mark Macarro, who is also a very small landowner on this allotment, interferred with their plans by kicking off their workers and prohibiting the continuation of their home.

Understandably, Mark was angry that his grandmother did not pay her taxes and Riverside County reclaimed the shares and put them up for auction. All of this happened before Mark was a member of the Tribe.

Never at any time did Mr. Macarro offer to purchase the property from us after Gil died, but did everything in his power to work underhandedly against us even to the extent of telling Indian Health to eliminate our files for a septic tank. Others were told to research us.

Mark and John Macarro, as well as others, know what self-centered and greedy people they are, so I ask you to pray for their souls. One of these people have craft in their hearts so be diligent in your prayers.

My intent was only to provide a home for Gilbert's children. Gil did so much for his People and felt blessed to be a part of Pechanga. I am grateful that he did not live to see this Tribe's actions.

So it was fee land that the Macarros didn't pay their taxes on that the family of Gilbert Tavizon legally bought and owns but who Mark Macarro abused his power by preventing them from building on it.

Trust land, on the other hand, doesn't require the owner to pay property taxes.

Can you imagine what would happen if a public official such as a mayor of a city used the police to keep people from building on land they legally owned?

Well what would happen is that mayor would be thrown out of office and put in jail.

Well Macarro reportedly used the tribal rangers to keep the Tavizons from finishing their home by preventing the people the Tavizons hired to do the job.

MARK MACARRO IS CORRUPT and he has quite a resume. I have started list, feel free to add to this list.

1. He promises the U.S Congress that no changes would be made to the Great Oak Ranch property but the tribe puts a golf course on this land once it is made part of the reservation. Thereby destroying culturally and environmentally sensitive land forever.

2. The above mentioned abuse of authority by keeping the Tavizons from building on their own legally owned land.

In response to the note that Indian Health "kowtowed", please be assured that they did not do that. Our re-application was honored since the services were for the children who were members; and only after that time, I was told about the situation.

They also told me that they respected my late husband; and because of that, would not sucumb to any threats against his family.
