Casino Indians Among Top Tax Cheaters in California

So, this is an answer to the question: Do Indians have to pay state taxes? YES, they do, if they live off the reservation. And now, thanks to the new list from the Franchise tax board, we KNOW who isn't paying from the RICHEST tribe in the state, the San Manuel Band.

Four San Manuel tribal members, including one who sits on the tribe's business committee, have made the Franchise Tax Board's list of the top 250 delinquent taxpayers in the state.

The board started publishing the list annually in 2007, which lists the top 250 taxpayers with liened state income tax delinquencies greater than $100,000.

Byron Marquez, a former minor league baseball player and brother of former tribal chairman Deron Marquez, is delinquent $439,024.47 as of April 2, 2008.

Marquez is director of business relations for the San Bernardino Inland Empire 66ers. He is also the president of the team's family outreach program and is director of the 66ers' dance team.

Stephanie Bustamante, the secretary of San Manuel's business committee, is delinquent $481,453 as of December.

Tribal member Kenneth Ramirez was delinquent $470,255.95 as of Nov. 4.

Tribal member Martin Hernandez Jr. was delinquent $700,092.87 as of Oct. 14.

SO GAMING IS COSTING US MONEY, as Californians. This is $2.1 MILLION that the San Manuel members are CHEATING Californians. How many teachers could keep their jobs if they paid what they owe?

That's not a true statement. If you look at the pamphlets that the state of California gives out, it says made up rules, there isn't any laws, code or statutes or cases that state california natives may get taxed on per capita. Besides look at the condition of the State of California there terrible with money. FYI California taxation of per capita can only happen if they have the laws written in place for it. read closely the pamphlet or what ever the FTB give out, codes and statutes. It is sad to say that native american governments aren't the only corrupt operations around.

Per capita not taxible? Tell that one to the Judge.

Why do native americans think that they can use all the same resources as the rest of the population, yet they shouldn't have to pay taxes?..what a priveleged group of people...!!..and arent these same tribal members from San Manuel getting over $100,000 each a month thrown in their lap?...what a bunch of egomaniacs...to hell with this group of Calfornians that are treated different than everyone else...PAY LIKE THE REST OF US...its time the citizens of California started staying out of these Casinos and spending their heavily taxed left over dollars somewhere else....we need to get some petitions going against this special treatment...

I am not stating that natives shouldn't pay taxes, lol. I am stating the us or any government should have laws set into place in order to tax. same resources, ha. were you aware that the california paid 600 dollars (roughly) for all of california's water and lets not talk about the land that was taken. we are talking trillions of dollars worth of land and then given land back were it was barren and nothing can grow. I am not throwing a pitty party and I believe everyone should do there part but it must be attained legally.

And who did the indians buy it from?..and i dont know about you, but I actually had to work hard and buy my land...no one gave it to me barren or not.... and that was hundreds of years ago...and these bloodlines have been so watered down ..they are hardly native american anymore.

The thing is, we legally own our allotted land so we have not done anything illegal in obtaining it but since I don't live on the reservation, when I was getting my per capita payments, I always paid California State income tax on that money.

I am sure there are people who don't live on reservations and who only use a tribal P.O. box who should have to pay state income tax.

An important part of my family having allotted land is it shows a connection to our tribe even if Pechanga officially says we are no longer a part of the tribe.

Since you ex-tribe members are probably the only ones that really know who lives on the reservation and who just uses a drop box or po box on the res...why dont you turn them in?..I believe that you would even be paid by the State for a percentage of money collected...and they keep it private about who turned in the cheaters...the State is in need of money..you guys could be a big help..maybe its time to play dirty like they did!!
